CASSELBERRY CITY COMMISSION <br />Minutes of March 8, 2021 — Regular Meeting <br />Page 10 of 19 <br />clarification of definitions, including residential vs. non-residential; when a permit is and is not required <br />prior to removal of a tree; whether there is a tree replacement requirement to pay into the City's tree bank <br />or replant; and defining applicable land uses to create some consistency and compatibility with the state <br />regulations. The ordinance clarifies language to make it very clear what is expected and references the <br />International Society of Arboriculture (ISA) Basic Tree Risk Assessment Form and provides penalties for <br />violation of the ordinance requirements. <br />Budget Impact: There is no impact to the City Budget. <br />Recommendation: The City Manager and the Community Development Director recommended adoption <br />of Ordinance 21-1548 on second and final reading. <br />Public Hearing: Mayor Henson stated this was a public hearing to hear and consider comments and <br />questions regarding Ordinance 21-1548. Mayor Henson opened the floor for public participation. No one <br />came forward to address Ordinance 21-1548. Mayor Henson closed the public hearing relative to <br />Ordinance 21-1548. <br />MOTION: Commissioner Aramendia moved to adopt Ordinance 21-1548 on second and <br />final reading, as presented. Motion was seconded by Vice Mayor Busch. <br />Motion carried unanimously by voice vote 5-0. <br />B. Second Reading of Ordinance 21-1549 — Issuance of Capital Improvement General <br />Obligation Bonds, In One or More Series <br />The City Clerk read Ordinance 21-1549 by title, as follows: <br />"AN ORDINANCE OF THE CITY OF CASSELBERRY, FLORIDA, AUTHORIZING THE <br />ISSUANCE OF ITS NOT TO EXCEED $24,000,000 GENERAL OBLIGATION BONDS IN <br />ORDER TO FINANCE THE RENOVATION, IMPROVEMENT AND CONSTRUCTION OF <br />VARIOUS CAPITAL IMPROVEMENTS, INCLUDING BUT NOT LIMITED TO, THE PARKS <br />AND RECREATION IMPROVEMENTS AND FACILITIES MORE PARTICULARLY <br />DESCRIBED HEREIN; PROVIDING AUTHORIZATION FOR THIS ORDINANCE; <br />PROVIDING FINDINGS; PROVIDING FOR THE PAYMENT OF SUCH BONDS FROM THE <br />PROCEEDS OF AD VALOREM TAXES LEVIED WITHIN THE CITY; AND PROVIDING FOR <br />SEVERABILITY, CONFLICTS, AND AN EFFECTIVE DATE." <br />Notice of Public Hearing: The Notice of Public Hearing relative to second reading of Ordinance 21-1549 <br />was advertised in the Orlando Sentinel on Thursday, February 25, 2021. <br />Staff Presentation: City Manager Randy Newlon stated that Ordinance 21-1549 provides for the City to <br />authorize the issuance of the Capital Improvement General Obligation Bonds, in one or more series, in <br />order to finance the renovation, improvement and construction of various capital improvements, including <br />but not limited to, the parks and recreation improvements and facilities in the principal amount not to exceed <br />$24,000,000, as approved by the voters of Casselberry in a bond referendum in March of 2020. He added <br />that Ordinance 21-1549 does not approve the actual issuance of any debt, but it approves the process to <br />move forward and accomplish that. <br />
