CASSELBERRY CITY COMMISSION Minutes of March 8, 2021 — Regular Meeting Page 10 of 19 clarification of definitions, including residential vs. non-residential; when a permit is and is not required prior to removal of a tree; whether there is a tree replacement requirement to pay into the City's tree bank or replant; and defining applicable land uses to create some consistency and compatibility with the state regulations. The ordinance clarifies language to make it very clear what is expected and references the International Society of Arboriculture (ISA) Basic Tree Risk Assessment Form and provides penalties for violation of the ordinance requirements. Budget Impact: There is no impact to the City Budget. Recommendation: The City Manager and the Community Development Director recommended adoption of Ordinance 21-1548 on second and final reading. Public Hearing: Mayor Henson stated this was a public hearing to hear and consider comments and questions regarding Ordinance 21-1548. Mayor Henson opened the floor for public participation. No one came forward to address Ordinance 21-1548. Mayor Henson closed the public hearing relative to Ordinance 21-1548. MOTION: Commissioner Aramendia moved to adopt Ordinance 21-1548 on second and final reading, as presented. Motion was seconded by Vice Mayor Busch. Motion carried unanimously by voice vote 5-0. B. Second Reading of Ordinance 21-1549 — Issuance of Capital Improvement General Obligation Bonds, In One or More Series The City Clerk read Ordinance 21-1549 by title, as follows: "AN ORDINANCE OF THE CITY OF CASSELBERRY, FLORIDA, AUTHORIZING THE ISSUANCE OF ITS NOT TO EXCEED $24,000,000 GENERAL OBLIGATION BONDS IN ORDER TO FINANCE THE RENOVATION, IMPROVEMENT AND CONSTRUCTION OF VARIOUS CAPITAL IMPROVEMENTS, INCLUDING BUT NOT LIMITED TO, THE PARKS AND RECREATION IMPROVEMENTS AND FACILITIES MORE PARTICULARLY DESCRIBED HEREIN; PROVIDING AUTHORIZATION FOR THIS ORDINANCE; PROVIDING FINDINGS; PROVIDING FOR THE PAYMENT OF SUCH BONDS FROM THE PROCEEDS OF AD VALOREM TAXES LEVIED WITHIN THE CITY; AND PROVIDING FOR SEVERABILITY, CONFLICTS, AND AN EFFECTIVE DATE." Notice of Public Hearing: The Notice of Public Hearing relative to second reading of Ordinance 21-1549 was advertised in the Orlando Sentinel on Thursday, February 25, 2021. Staff Presentation: City Manager Randy Newlon stated that Ordinance 21-1549 provides for the City to authorize the issuance of the Capital Improvement General Obligation Bonds, in one or more series, in order to finance the renovation, improvement and construction of various capital improvements, including but not limited to, the parks and recreation improvements and facilities in the principal amount not to exceed $24,000,000, as approved by the voters of Casselberry in a bond referendum in March of 2020. He added that Ordinance 21-1549 does not approve the actual issuance of any debt, but it approves the process to move forward and accomplish that.
