CASSELBERRY CITY COMMISSION <br />Minutes of March 8, 2021 — Regular Meeting <br />Page 11 of 19 <br />Budget Impact: Before the debt is authorized, City Commission will be asked for its approval by <br />resolution. If approved, debt is expected to be issued at the City Commission meeting scheduled for March <br />8, 2021. Budget impact will be recognized at that time. <br />Recommendation: The City Manager and the Finance Director recommended adoption of Ordinance 21- <br />1549. <br />Public Hearing: Mayor Henson stated this was a public hearing to hear and consider comments and <br />questions regarding Ordinance 21-1549. Mayor Henson opened the floor for public participation. No one <br />came forward to address Ordinance 21-1549. Mayor Henson closed the public hearing relative to <br />Ordinance 21-1549. <br />MOTION: Vice Mayor Busch moved to adopt Ordinance 21-1549 on second and final <br />reading, as presented. Motion was seconded by Commissioner Aramendia. <br />Motion carried unanimously by voice vote 5-0. <br />C. Second Reading of Ordinance 21-1550 — Amending the Official Zoning <br />Designation for the Property Located at 198 SR 436 (ZB 20-04) <br />The City Clerk read Ordinance 21-1550 by title, as follows: <br />"AN ORDINANCE OF THE CITY OF CASSELBERRY, FLORIDA, TO AMEND THE CITY OF <br />CASSELBERRY OFFICIAL ZONING MAP AS ESTABLISHED IN CHAPTER II, ARTICLE IV, <br />SECTION 2-4.3, UNIFIED LAND DEVELOPMENT REGULATIONS OF THE CITY OF <br />CASSELBERRY, FLORIDA, AS AMENDED AND SUPPLEMENTED; AMENDING THE <br />ZONING CLASSIFICATION FROM CG (COMMERCIAL GENERAL) TO PMX-HIGH <br />(PLANNED MIXED-USE: HIGH RISE) FOR APPROXIMATELY 0.93 ACRES LOCATED AT 198 <br />STATE ROAD 436, AS DESCRIBED IN SECTION I OF THIS ORDINANCE; PROVIDING FOR <br />CONFLICTS, SEVERABILITY, AND AN EFFECTIVE DATE." <br />Notice of Public Hearing: The Notice of Public Hearing relative to second reading of Ordinance 21-1550 <br />was advertised in the Orlando Sentinel on Thursday, February 25, 2021. <br />Staff Presentation: Planner II Christina Hyson stated that Ordinance 21-1550 amends the official zoning <br />designation for one (1) parcel located at 198 SR 436 from CG (Commercial General) to PMX-HIGH <br />(Planned Mixed -Use: High Rise). The subject property is approximately 0.93 acres in size and is located <br />at the northwest corner of the intersection of State Road 436 and Oxford Road. Notification was provided <br />to the surrounding property owners within 500 feet on December 28, 2020, and written notices for the <br />Official Zoning Map amendment were posted on the subject property on December 23, 2020. The Planning <br />and Zoning Commission, serving as the City's Local Planning Agency (LPA) voted unanimously at its <br />meeting on January 13, 2021 to recommend approval of this item to the City Commission. There were <br />some minor changes to the PUD Agreement between first and second reading in order to clarify the notice <br />requirement in Paragraph 22 and binding effect in Paragraph 25. The request to amend the Official Zoning <br />Map from CG (Commercial General) to PMX-HIGH (Planned Mixed -Use: High Rise) for the subject <br />property is: consistent with the City's Comprehensive Plan and the Major Thoroughfare Mixed -Use Future <br />
