City Attorney Reischmann stated she did not believe the City would have any liability for the <br />contamination of the property that had occurred before it was purchased, but she also did not think the City <br />had any recourse back to Chevron, which was the previous owner. Mr. Newlon explained that the City had <br />incurred cost to remediate the property; however much of the significant cost had been at least partially <br />reimbursed from the State of Florida through a tax credit program. <br />MOTION: Commissioner Aramendia moved to approve Resolution 21-3226, as presented. <br />Motion was seconded by Vice Mayor Busch. Motion carried unanimously by <br />voice vote 4-0. <br />10. FIRST READING OF ORDINANCES <br />No items were presented for consideration on this agenda. <br />11. PUBLIC HEARINGS <br />A. Second Reading of Ordinance 21-1547 — Amending Chapter 86 Utilities Article <br />III, Division 2 Section 86-192 of the City Code of Ordinances — Adjustments of <br />Water and Sewer Bills <br />The City Clerk read Ordinance 21-1547 by title, as follows: <br />"AN ORDINANCE OF THE CITY OF CASSELBERRY, FLORIDA, AMENDING SUBSECTION <br />(D)(2)(a) OF SECTION 86-192, "ADJUSTMENTS OF WATER AND SEWER BILLS" OF <br />CHAPTER 86, UTILITIES, ARTICLE III, DIVISION 2 — RATES AND CHARGES, TO BETTER <br />DESCRIBE THE ADJUSTMENTS TO THE CUSTOMERS' BILLS; PROVIDING FOR <br />CODIFICATION, CONFLICTS, SEVERABILITY AND AN EFFECTIVE DATE." <br />Notice of Public Hearing: The Notice of Public Hearing relative to second reading of Ordinance 21-1547 <br />was advertised in the Orlando Sentinel on Thursday, February 11, 2021. <br />Staff Presentation: Ordinance 21-1547 amends Chapter 86, Utilities, Article III, Division 2, Section 86- <br />192(d), Subsection 2(a) — Adjustments of Water and Sewer Bills of the City Code of Ordinances. Ordinance <br />20-1544, adopted on November 16, 2020 allows for sewer on a month's bill to be capped by the City <br />Manager, or his/her designee at 15,000 gallons or the average consumption for the past 12 months, <br />whichever is higher, for proven increased water consumption. City Manager Randy Newlon explained that <br />Ordinance 21-1547 amends the adjustment policy to extend to unexplained or unintended sewer usage and <br />to use the same cap of 15,000 gallons or average consumption for the past 12 months as it is for proven <br />increased water consumption, which would put the same protection for either explained or unexplained <br />increases and which he hoped would be helpful and beneficial to the City's utility customers. <br />Budget Impact: There is no impact to the City Budget. <br />Recommendation: The City Manager and the Finance Director recommended adoption of Ordinance 21- <br />1547. <br />
