CASSELBERRY CITY COMMISSION <br />Minutes of February 22, 2021 — Regular Meeting <br />Page 8 of 14 <br />Mayor Henson noted that he had not asked for Citizens' Comments relating to the Consent Agenda earlier <br />in the meeting. He apologized to the audience and asked if there was anyone who wished to speak to any <br />item on the Consent Agenda. No one came forward. <br />9. RESOLUTIONS <br />A. Resolution 21-3226 — Sixth Amendment to the Acquisition Agreement and Option <br />to Purchase with Casto Casselberry, LLC <br />The City Clerk read Resolution 21-3226 by title, as follows: <br />"A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF CASSELBERRY, <br />FLORIDA, AUTHORIZING THE EXECUTION OF A SIXTH AMENDMENT TO THE <br />ACQUISITION AGREEMENT AND OPTION TO PURCHASE BETWEEN CASTO <br />CASSELBERRY, LLC AND THE CITY OF CASSELBERRY; PROVIDING FOR CONFLICTS, <br />SEVERABILITY, AND EFFECTIVE DATE." <br />Staff Presentation: City Manager Randy Newlon stated that Resolution 21-3226 provides for the Sixth <br />Amendment to the Acquisition Agreement and Option to Purchase with Casto Casselberry, LLC (Casto). <br />He gave a brief overview of events leading to the City's purchase of the property north of the Police Station <br />and explained that Casselberry had opted to exercise its Option to Purchase on the property and that the <br />Acquisition Agreement entered between Casto and the City included a defined time for inspection. <br />However, since the Police Station site was the source of a brownfield which the City had worked to <br />remediate over many years, Casto was in the process of doing its due diligence to determine if any <br />environmental issues from the Police Station site had extended into the property they were seeking to <br />acquire. Mr. Newlon explained that Casto had conducted a Phase I Environmental Study, which was mostly <br />an observational report, and were requesting an extension of time in which to conduct a Phase II <br />Environmental Study which would involve actual probing and testing of the soil on the property. He stated <br />he would recommend approval of the 29 -day extension to the inspection period as requested by Casto. <br />Budget Impact: There is no impact to the City Budget. <br />Recommendation: The City Manager recommended approval of Resolution 21-3226. <br />Audience Participation: The following individual came forward to address Resolution 21-3226. <br />Ms. Colleen Hufford, 527 Queens Mirror Circle stated she was in favor of the additional 29 <br />days to allow Casto to complete their due diligence; however, she felt they should be held <br />accountable to get the work completed on time and was not in favor of a further extension after <br />that. <br />No one else came forward. <br />Discussion: A brief discussion ensued regarding previous environmental studies done when the City <br />purchased the property and whether there was any recourse for the City in recouping the cost of the <br />
