CASSELBERRY CITY COMMISSION <br />Minutes of April 12, 2021 — Regular Meeting <br />Page 9 of 15 <br />MOTION: Commissioner Aramendia moved to adopt Ordinance 21-1551 on second and <br />final reading, as presented. Motion was seconded by Commissioner <br />Meadows. Motion carried unanimously by voice vote 5-0. <br />B. Second Reading of Ordinance 21-1552 — Amending; the Official Zoning <br />Designation for the Property Located at 1391 State Road 436 (ZB 20-05) <br />The City Clerk read Ordinance 21-1.552 by title, as follows: <br />"AN ORDINANCE OF THE CITY OF CASSELBERRY, FLORIDA, TO AMEND THE CITY OF <br />CASSELBERRY OFFICIAL ZONING MAP AS ESTABLISHED IN CHAPTER II, ARTICLE IV, <br />SECTION 2-4.3, UNIFIED LAND DEVELOPMENT REGULATIONS OF THE CITY OF <br />CASSELBERRY, FLORIDA, AS AMENDED AND SUPPLEMENTED; AMENDING THE <br />ZONING CLASSIFICATION FROM CG (COMMERCIAL GENERAL) TO PMX-MID <br />(PLANNED MIXED-USE: MEDIUM RISE) FOR APPROXIMATELY 2.37 ACRES LOCATED AT <br />1391 STATE ROAD 436, AS DESCRIBED IN SECTION I OF THIS ORDINANCE; PROVIDING <br />FOR CONFLICTS, SEVERABILITY, AND AN EFFECTIVE DATE." <br />Notice of Public Hearing: The Notice of Public Hearing relative to Ordinance 21-1552 was advertised in <br />the Orlando Sentinel on Thursday, April 1, 2021. <br />Budget Impact: There is no impact to the City Budget. <br />Recommendation: The City Manager and the Community Development Director recommended adoption <br />of Ordinance 21-1552 on second and final reading. <br />Staff Presentation: Planner II Christina Hyson stated that Ordinance 21-1552 and the associated PUD <br />(Planned Unit Development) Agreement amends the official zoning designation for one (1) parcel located <br />at 1391 State Road 436 from CG (Commercial General) to PMX-MID (Planned Mixed -Use: Medium Rise). <br />The subject area consists of one (1) parcel approximately 2.37 acres in size. The proposed PUD Agreement <br />is included as Attachment B to Ordinance 21-1552 and will be executed upon adoption of the ordinance. <br />Notification was provided to the surrounding property owners within 500 feet on January 25, 2021, and <br />written notices for the Official Zoning Map amendment were posted on the subject property on January 20, <br />2021. The City's Development Review Committee (DRC) approved the concept plan for ZB 20-05 on <br />December 17, 2020. The Planning and Zoning Commission, serving as the City's Local Planning Agency <br />(LPA), voted unanimously at its meeting on February 10, 2021 to recommend approval of this item to the <br />City Commission. Ms. Hyson advised that had been some minor changes to the ordinance and PUD <br />Agreement since approval on first reading which included removing Exhibit C and reference to it in <br />paragraph 4; removing the reference to Developer on page 11; and updating the concept plan with a higher <br />quality image for recording. The request to amend the Official Zoning Map from CG (Commercial General) <br />to PMX-MID (Planned Mixed -Use: Medium Rise) for the subject property is: consistent with the City's <br />Comprehensive Plan and the Major Thoroughfare Mixed -Use Future Lane Use designation; compatible and <br />consistent with the adjacent land uses and zoning districts; and connections for City water and sanitary <br />sewer services are available to the subject property. <br />Public Hearing: Mayor Henson stated this was a public hearing to hear and consider comments and <br />
