WHEREAS, certain modifications and additions to the City's zoning regulations and land <br />uses are needed, as authorized by Future Land Use Policy 7.1 of the City's Comprehensive Plan, <br />to provide the City of Casselberry with specific and detailed redevelopment guidelines for the <br />Seminola Dog Track District; and <br />WHEREAS, the Casselberry City Commission formally adopts the Seminola Boulevard <br />and Seminola Dog Track Small Area Studies as a growth management guide for the <br />redevelopment of the properties adjacent to the roadway and at the former Seminole Greyhound <br />Park; and <br />WHEREAS, the Casselberry City Commission finds that the existence of a communication <br />tower may be appropriate in the Community section of the District so long as the conditional use <br />criteria of Chapter II, Article VI, of the City Code are met and that a proposed tower does not have <br />a negative impact on property values and aesthetics; and <br />WHEREAS, the Casselberry City Commission formally adopts the revised Seminola Dog <br />Track Small Area Study "Implementation Measures" with attachments, which, along with the <br />approved Seminola Boulevard and the Seminola Dog Track Small Area Studies, forms the basis <br />for a new overlay zoning district to be entitled the "Seminola Boulevard Overlay Zoning District" <br />with two distinct sub -areas, Phase I, to be known as "SB -1" and Phase ll, to be known as "SB -2" <br />as authorized in Future Land Use Policies 7.1 and 10.3 of the City's Comprehensive Plan; and <br />WHEREAS, the Casselberry City Commission finds this Ordinance serves a legitimate <br />governmental interest in preserving the quality of urban life by discouraging the proliferation of <br />urban sprawl and encouraging the redevelopment of infill properties per Objectives 2, 3 and 5 of <br />the Future Land Use Element of the City's Comprehensive Plan; and <br />WHEREAS, the Casselberry Planning and Zoning Commission / Local Planning Agency, <br />reviewed this ordinance and found it to be consistent with the City's Comprehensive Plan. <br />Page 3 of 29 <br />Ordinance 02-1071 <br />
