CASSEL11ERRY CITY COMMISSION <br />Minutes of November 16, 2020 — Regular Meeting <br />Page 17 of 22 <br />Budget Impact: Sufficient funds are appropriated in the Capital Improvement Fund Building Improvement <br />Accounts #305-0190-519.62-25, #305-0190-536.62-25 and #305-0740-538.62-25. Budget Amendment <br />#21-008 reallocates a portion of the funds to provide for correct coding of equipment and other <br />improvement purchases in various Capital Improvement Funds Equipment and Other -Improvement <br />accounts. <br />Recommendation: The City Manager and the Public Works Director recommended approval of Exhibit <br />B Construction Management Agreement Guaranteed Maximum Price (GMP) Amendment No. 1 for the <br />Contract Agreement with Wharton -smith, Inc. for Construction Manager at Risk services for the Public <br />Works Department Complex to authorize construction of the project at the Guaranteed Maximum Price of <br />$15,370,599. <br />Audience Participation: No one came forward to address the Commission regarding this item. <br />MOTION: Commissioner Albritton moved to defer action on Construction Management <br />Agreement Guaranteed Maximum Price Amendment No. 1 with Wharton - <br />Smith, Inc. for Construction Manager at Risk Services for the Public Works <br />Department Complex and Related Budget Amendment #21-008 until the next <br />regular City Commission meeting on December 14, 2020. <br />Motion failed for lack of a second. <br />Discussion: C ofiitiiissioner Meadows expressed understanding of Coiritnissloner Albritton's hesitation <br />about the project; however, planning for this project had started several years ago and the decision had been <br />made to renovate the compound at its current site, while saving the property to the north for potential park <br />space which is what the citizens have now voted on and approved. He added that he did not believe the <br />City would get a better interest rate than was being offered; he was comfortable with the thought process <br />that had been put into the project; the compound needed to be brought up to standards including storm <br />ratings for the buildings; and the additional square footage would allow for future growth as staff and <br />equipment are added to maintain proper services to the citizens in the coming decades. <br />MOTION: Commissioner Aramendia moved to approve Construction Management <br />Agreement Guaranteed Maximum Price Amendment No. 1 with Wharton - <br />Smith, Inc. for Construction Manager at Risk Services for the Public Works <br />Department Complex and Related Budget Amendment #21-008, as amended. <br />Motion was seconded by Commissioner Busch. Motion carried by voice vote <br />4-1, Commissioner Albritton dissenting. <br />B. Change Order No. 3 to the Agreement with Bentley Architects + Engineers, Inc. <br />for Design Services for Public Works Department Complex <br />Staff Presentation: Public Works Director Mark Gisclar stated that Change Order No. 3 to the Agreement <br />with Bentley Architects + Engineers, Inc. provides post design services and construction administration for <br />the 28 month duration for the Public Works Department Complex project in the amount of $229,881.01 <br />(Ref SOQ-2018-0382). He introduced Mr. Gary Kranston, the Project Architect with Bentley Architects + <br />Engineers who was present at the meeting. He explained that post design services include anything that <br />
