CASSELBERRY CITY COMMISSION <br />Minutes of November 16, 2020 — Regular Meeting <br />Page 16 of 22 <br />The City Clerk read Ordinance 20-1544 by title, as follows: <br />"AN ORDINANCE OF THE CITY OF CASSELBERRY, FLORIDA, AMENDING SECTION 86- <br />192, "ADJUSTMENTS OF WATER AND SEWER BILLS" OF CHAPTER 86, UTILITIES, <br />ARTICLE III, DIVISION 2 — RATES AND CHARGES, TO BETER DELINEATE THE CITY'S <br />AUTHORITY TO ADJUST UTILITY BILLS; PROVIDING FOR CODIFICATION, CONFLICTS, <br />SEVERABILITY AND AN EFFECTIVE DATE." <br />Notice of Public Hearing: The Notice of Public Hearing relative to Ordinance 20-1544 was advertised in <br />the Orlando Sentinel on Thursday, November 5, 2020. <br />Staff Presentation: City Manager Randy Newlon stated that Ordinance 20-1544 amends Chapter 86, <br />Article 111, Division 2 Section 86-192 — Adjustments of Water and Sewer Bills of the City Code of <br />Ordinances to better delineate the City's authority to adjust utility bills, including adjustments to irrigation <br />charges, whether potable water or reclaimed water. <br />Budget Impact: There is no foreseeable impact to the City Budget. <br />Recommendation: The City Manager and the Finance Director recommended adoption of Ordinance 20- <br />1544 on second reading. <br />Public Hearing: Mayor Henson stated this was a public hearing to hear and consider comments and <br />rP 1• u n_ c d fl, . for , <br />,questionsregarding Ordinance 2 -1 44. Mayor Henson opened the floor �, public particlpat;oii. No one <br />came forward to address Ordinance 20-1544. Mayor Henson closed the public hearing relative to <br />Ordinance 20-1544. <br />MOTION: Commissioner Busch moved to adopt Ordinance 20-1544 on second and final <br />reading, as presented. Motion was seconded by Commissioner Aramendia. <br />Motion carried unanimously by voice vote 5-0. <br />12. OTHER ITEMS <br />A. Construction Management Agreement Guaranteed Maximum Price Amendment <br />No. 1 with Wharton -Smith, Inc. for Construction Manager at Risk Services for the <br />Public Works Department Complex and Related Budget Amendment #21-008 <br />Staff Presentation: Public Works Director Mark Gisclar stated that Exhibit B Construction Management <br />Agreement Guaranteed Maximum Price (GMP) Amendment No. 1 for the Contract Agreement with <br />Wharton -Smith, Inc. for Construction Manager at Risk (CMAR) services for the Public Works Department <br />Complex provides for commencing with construction of the project at a Guaranteed Maximum Price of <br />$15,370,599 (Ref. SOQ-2019-0411). Related BA #21-008 reallocates a portion of the previously approved <br />budget from Building Improvements to Equipment and Improvements -Other. He then explained that the <br />Guaranteed Maximum Price (GMP) for the project was $15,370,599, but lie expected there to be savings <br />on the project from the owner direct purchase project, unused contingency funds and savings in the event <br />less soil remediation is needed. <br />
