The structure may require a permit through Florida Department of Environmental Protection (FDEP). <br />Evidence of an FDEP permit or exemption/self-certification must be provided with a building permit <br />submittal. More information can be found at http://www.dep.state,fl.us/water/wetlands/. <br />ii. As this structure exceeds four feet in width, the City's Unified Land Development Regulations (ULDR) <br />with regard to Environmental Protection apply to this structure. In particular, Section 3- 11.5 Lakeshore <br />Protection will apply. The submittal should include a plan for permanent native re -vegetation of the <br />shoreline to bring it into compliance with City Code and State Law. City staff can assist by suggesting <br />plant species if needed. More information can be found at http://www.casselberry,org/lakes. <br />iii. NO FILL may be imported without compensating storage as part of the dock's construction for <br />the portion that lies within the Special Flood Hazard Area (SFHA), also known as the 100 year <br />floodplain. <br />2. Per Section 94-6 of the City Code of Ordinances, this dock must be properly lit from sunset to sunrise to show <br />its overall length, as it is proposed to extend farther than 20 feet from the shoreline. <br />3. Homeowner's association (HOA) approval must be provided at the time of building permit submission. <br />4. The conditional use shall commence within 120 days of the approval. <br />5. The dock must be kept in good condition. The conditional use shall become null and void if the dock sustains <br />damage or falls into disrepair and is not repaired or replaced within six months and is taken before the Special <br />Magistrate for the Code violation. <br />6. A new conditional use will be required if the size or dimensions of the dock is increased. <br />7. The site's numerical address must be clearly posted on the dock in an area that is visible from the waterbody. <br />8. All of the above conditions shall be fully and faithfully executed or the conditional use shall become null and <br />void. <br />After a brief discussion regarding the posting of the address on the dock, Mr. Henson asked the applicant to come <br />forward. Mr. Mike Caiazza, contractor, 229 Wood Lake Drive, Maitland, Florida came forward. There were no questions for <br />the applicant. <br />Mr. Henson asked if there was anyone in the audience who wished to speak in favor of, or in opposition to, the <br />request. No one came forward. <br />Mr. Henson asked for a motion to address CU 19-17. Mr. Hale made a motion that the Planning and Zoning <br />Commission approve CU 19-17 to allow a residential boat dock at 666 San Pablo Avenue based on the findings of fact and <br />conclusions of the staff report dated October 9, 2019, and the eight (8) conditions outlined in the staff report including <br />Attachments A — B. Mr. Bakalla seconded the vote. The motion passed unanimously by voice vote. <br />The agenda order was modified. <br />Ninth Item of Business: LPA 19-16: 2020 Capital Improvement Program. An ordinance to adopt the 2020-2024 Capital <br />Improvement Program into the City's Comprehensive Plan. <br />Ms. Christina Hyson, Planner II, reviewed the information provided in her memorandum dated October 9, 2019 to the <br />City of Casselberry Planning and Zoning Commission.
