Planning & Zoning Commission/ <br />Local Planning Agency Minutes <br />September 11, 2019 <br />Page 3 <br />Ms. Christina Hyson, Planner II, reviewed the information provided in her memorandum dated September <br />11, 2019 to the City of Casselberry Planning and Zoning Commission. A copy of the rezoning notification letter that <br />was sent to the residents within 500 feet of the subject property along with a copy of the mailing labels for those <br />property owners was distributed to the Planning and Zoning Commission (copies are attached and made a part of the <br />minutes). <br />Ms. Hyson said staff recommends that the Planning and Zoning Commission provide a favorable <br />recommendation to the City Commission for ZB 19-07 to amend the Official Zoning Map from R-9 (Low Density <br />Single -Family) to CG (Commercial General) for the subject property located at 245 Lake Ellen Drive. She said staffs <br />recommendation is based on the findings of fact and conclusions of the staff report dated September 11, 2019, and <br />the three (3) findings regarding the proposed change to the Official Zoning Map outlined in the staff report. The <br />finding of facts are: <br />1. The requested amendment to the Official Zoning Map is consistent with the City's Comprehensive Plan <br />and the Commercial Future Land Use designation; and <br />2. The requested amendment to the Official Zoning Map is compatible with the surrounding mix of land <br />uses and zoning districts; and <br />3. City water and sanitary sewer services are available to the subject property. However, the impact of the <br />proposed Official Zoning Map amendment on existing sewer capacity cannot be determined until the <br />type of use is established and a flow capacity test is completed. <br />In response to the Commission's question, Ms. Hyson explained that Attachment B is a Florida Statute <br />requirement and that verbiage would be included in future staff reports. <br />Mr. Henson asked the applicant to come forward. Mr. Bobby Wanas, 431 East Horatio Avenue, Maitland, <br />Florida came forward. Mr. Wanas said he agrees with staffs recommendations. <br />Mr. Henson asked if there was anyone in the audience who wished to speak in favor of, or in opposition to, <br />the request. Ms. Michele Throm, 235 Lake Ellen Drive, Casselberry, Florida came forward. Ms. Throm questioned <br />what a noise buffer would consist of. She expressed concerns with noise and traffic that would be generated from a <br />commercial business at that location. She requested the zoning remain as residential. <br />Mr. Laurence Toncic, 243 Lake Ellen Drive, Casselberry, Florida came forward. Mr. Toncic expressed <br />concerns with noise and the impact to his neighborhood. <br />
