Planning & Zoning Commission/
Local Planning Agency Minutes
September 11, 2019
Page 3
Ms. Christina Hyson, Planner II, reviewed the information provided in her memorandum dated September
11, 2019 to the City of Casselberry Planning and Zoning Commission. A copy of the rezoning notification letter that
was sent to the residents within 500 feet of the subject property along with a copy of the mailing labels for those
property owners was distributed to the Planning and Zoning Commission (copies are attached and made a part of the
minutes).
Ms. Hyson said staff recommends that the Planning and Zoning Commission provide a favorable
recommendation to the City Commission for ZB 19-07 to amend the Official Zoning Map from R-9 (Low Density
Single -Family) to CG (Commercial General) for the subject property located at 245 Lake Ellen Drive. She said staffs
recommendation is based on the findings of fact and conclusions of the staff report dated September 11, 2019, and
the three (3) findings regarding the proposed change to the Official Zoning Map outlined in the staff report. The
finding of facts are:
1. The requested amendment to the Official Zoning Map is consistent with the City's Comprehensive Plan
and the Commercial Future Land Use designation; and
2. The requested amendment to the Official Zoning Map is compatible with the surrounding mix of land
uses and zoning districts; and
3. City water and sanitary sewer services are available to the subject property. However, the impact of the
proposed Official Zoning Map amendment on existing sewer capacity cannot be determined until the
type of use is established and a flow capacity test is completed.
In response to the Commission's question, Ms. Hyson explained that Attachment B is a Florida Statute
requirement and that verbiage would be included in future staff reports.
Mr. Henson asked the applicant to come forward. Mr. Bobby Wanas, 431 East Horatio Avenue, Maitland,
Florida came forward. Mr. Wanas said he agrees with staffs recommendations.
Mr. Henson asked if there was anyone in the audience who wished to speak in favor of, or in opposition to,
the request. Ms. Michele Throm, 235 Lake Ellen Drive, Casselberry, Florida came forward. Ms. Throm questioned
what a noise buffer would consist of. She expressed concerns with noise and traffic that would be generated from a
commercial business at that location. She requested the zoning remain as residential.
Mr. Laurence Toncic, 243 Lake Ellen Drive, Casselberry, Florida came forward. Mr. Toncic expressed
concerns with noise and the impact to his neighborhood.
