Planning & Zoning Commission/ Local Planning Agency Minutes September 11, 2019 Page 2 condition of approval for the site plan (SPR 18-33) that the Planning and Zoning Commission approved at a previous meeting. He said the lots required replatting to document the various easements to the adjoining parcels and the wetland mitigation. The applicant has submitted the final plat that meets the conditions of approval and this item is ready to be scheduled for review by the City Commission. Mr. Fathelbab said staff requests the Planning and Zoning Commission review SP 19-04, Glen Academy at Lake Marie, final plat, and provide a recommendation of approval to the City Commission. He said the recommendation is based upon the plat, Attachment A, the findings of fact and conclusions of the staff report dated September 11, 2019, and the two (2) conditions outlined in the staff report. The conditions of approval are: 1. Prior to final approval by the City Commission, the applicant shall make the necessary changes to the plat based on the remaining comments. The applicant will then resubmit the plat and any necessary documentation to allow the City to review and ensure all necessary changes and requirements have been met. 2. The City Surveyor, City Engineer, Community Development Director, City Clerk, and City Mayor shall execute the signature block prior to recording of the plat. Mr. Fathelbab stated that the applicant was not present at the meeting. Mr. Henson asked if there was anyone in the audience who wished to speak in favor of, or in opposition to, the request. No one came forward. In response to the Commission's question, Mr. Fathelbab explained that the site plan and platting process differs based on the development. He said if changes are made to a site plan that could affect the plat, the replatting process is delayed until the final site plan is completed. Mr. Henson asked for a motion to address SP 19-04. Mr. Phillips made a motion that the Planning and Zoning Commission approve SP 19-04, Glen Academy at Lake Marie, final plat, and provide a recommendation of approval to the City Commission based upon the plat, Attachment A, the findings of fact and conclusions of the staff report dated September 11, 2019, and the two (2) conditions of approval outlined in the staff report including Attachment A. Ms. Campbell seconded the motion. The motion passed unanimously by voice vote. Fifth Item of Business: ZB 19.07: 245 Lake Ellen Drive. A request to amend the Official Zoning Map from R-9 (Low Density Single -Family) to CG (Commercial General) for the property located at 245 Lake Ellen Drive.
