Planning & Zoning Commission/ <br />Local Planning Agency Minutes <br />August 14, 2019 <br />Page 6 <br />Mr. Henson asked if there was anyone in the audience who wished to speak in favor of, or in opposition to, <br />the request. Mr. Robert Buckley, 239 Lake Ellen Drive, Casselberry, Florida, came forward to speak against the <br />request. Mr. Buckley stated that he has spoken at numerous Planning and Zoning Commission and City <br />Commission meetings over the past 27 years and he has more than a layman's experience and understanding in <br />zoning rules, regulations, and processes. He expressed a concern that the City has no legal obligation to notify by <br />mail any of the residents impacted by this meeting. He said that the applicant notified the neighbors regarding <br />tonight's agenda item. He felt that the City's notification process is seriously flawed. <br />Mr. Buckley requested the Planning and Zoning Commission deny this application at this time. Mr. Buckley <br />requested the remainder of his three (3) minutes be used to celebrate the memory of his friend, John Casselberry. <br />Ms. Brenda Monger, 15 Plumosa Avenue, Casselberry, Florida, came forward to speak in opposition to the <br />request. Ms. Monger expressed concerns with the runoff impacting the lake, traffic concerns, and a commercial use <br />located adjacent to a residential use. Ms. Monger requested the Planning and Zoning Commission deny this request. <br />Mr. Henson explained that the project would require approval from the St. Johns River Water Management <br />District. He said most of the concerns of the neighbors would be addressed at the site plan review process. He said <br />tonight's item is a change to the Future Land Use designation only. <br />Mr. Henson stated that the size of the signage used for notification for land use changes is very small. He <br />said a suggestion was made that the City adhere the existing signs to a larger piece of plywood. In response to the <br />Commission's question, Ms. Hyson explained that this item was advertised in the Orlando Sentinel on August 1, <br />2019, the agenda was posted on the City's bulletin board on August 7, 2019, and the placard was posted on the <br />property on July 25, 2019. She said the City Code does not have any regulations regarding notification via letter to <br />property owners within 500 -feet for future land use map amendments. Ms. Hyson stated that all property owners <br />within 500 feet of the property would be notified for the rezoning meeting. <br />After a brief discussion, Mr. Henson asked for a motion to address LPA 19-11. Mr. Phillips made a motion <br />that the Planning and Zoning Commission provide a favorable recommendation to the City Commission for LPA 19- <br />11 to amend the Future Land Use Map designation from Low Density Residential to Commercial for the subject <br />property, located at 245 Lake Ellen Drive, based on the findings of fact and conclusions of the staff report dated <br />
