The motion <br />passed unanimously by voice vote. <br />Sixth Item of Business: BA 19-04: 226 Overbrook Drive. A variance request to Section 2-5.4, Table 2.5.4 of <br />the ULDR to reduce the 204 rear yard setback to 104 to allow a shed. <br />Ms. Christina Hyson, Planner II, reviewed the information provided in her memorandum dated August 14, <br />2019, to the City of Casselberry Planning and Zoning Commission. Ms. Hyson said the variance application to <br />reduce the rear lot line setback for placement of a shed (BA 19-04) meets the eleven "test of variance" criteria for <br />granting a variance to the City's land development regulations. Ms. Hyson said staff recommends that the Planning <br />and Zoning Commission approve the variance request, subject to the following conditions of approval: <br />1. The variance shall only pertain to the proposed shed as displayed in Attachment B. <br />2. A building permit for the construction of the proposed shed shall be obtained within six (6) months of <br />variance approval. <br />3. All of the above conditions shall be fully and faithfully executed or the variance shall become null and void. <br />After a brief discussion regarding the City Code prohibiting sheds from being placed in the front yard, Mr. <br />Henson asked the applicant to come forward. Ms. Martha Malaver, 226 Overbrook Drive, Casselberry, Florida, came <br />forward. There were no questions for the applicant. <br />Mr. Henson asked if there was anyone in the audience who wished to speak in favor of, or in opposition to, <br />the request. Mr. Bruce Karp, 232 Overbrook Drive, Casselberry, Florida, came forward. Mr. Karp expressed <br />concerns with flooding issues on his property, if the shed was placed in the proposed location. He suggested the <br />shed be placed on the opposite side of the proposed location. <br />The Commission questioned the science behind Mr. Karp's claims that the location of the proposed shed <br />would impact his property. Ms. Hyson reviewed the location of the proposed shed. She explained that the shed <br />meets the side yard setback; however, the variance requested is for the rear yard setback. A general discussion <br />ensued regarding changing the location of the proposed shed to the opposite side of the property. <br />Mr. Karp left the meeting after the audience participation portion of the meeting. <br />Mr. Henson asked for a motion to address BA 19-04. Mr. Phillips made a motion that the Planning and <br />Zoning Commission approve the variance application to reduce the rear lot line setback for placement of a shed. BA <br />
