Planning & Zoning Commission/ Local Planning Agency Minutes July 10, 2019 Page 3 Mr. Dean Fathelbab, Planner ll, reviewed the information provided in his memos dated July 10, 2019 to the City of Casselberry Planning and Zoning Commission. Mr. Fathelbab said staff recommends the Planning and Zoning Commission approve CU 19-12 to operate a daycare facility at 1300 Seminola Boulevard. He said staffs recommendation is based on the findings of fact and conclusions of the staff report dated July 11, 2019, and the seven (7) conditions of approval including Attachment A. The conditions of approval are: 1. The conditional use shall be limited to the location of 1300 Seminola Boulevard. 2. The business shall remain in complete compliance with all City, County and State requirements. 3. There shall be no outside display or storage of goods, materials, services, or vehicles. 4. All applicable licenses and permits shall be obtained prior to the commencement of any business activities at the site. 5. The conditional use shall commence within one year of approval. 6. A new conditional use application shall be required if the use should cease for more than 90 days. 7. All of the above conditions shall be fully and faithfully executed or the conditional use shall become null and void. A brief discussion ensued regarding the parking waivers and the St. Johns River Water Management District permit. Mr. Henson explained these are site plan items and would be discussed during the site plan review portion of the meeting. In response to the Commission's question, Mr. Fathelbab explained that the project would require platting of the property to aggregate the four lots. Mr. Fathelbab stated that it is more efficient to approve the site plan prior to replatting the property. Mr. Henson asked the applicant to come forward. Mr. Robert Ziegenfuss, 708 East Colonial Drive, Orlando, Florida came forward. There were no questions for the applicant. Mr. Henson asked if there was anyone in the audience who wished to speak in favor of, or in opposition to, the request. No one came forward. Mr. Henson asked for a motion to address CU 19-12. Mr. Hale made a motion that the Planning and Zoning Commission approve CU 19-12 to operate a daycare facility at 1300 Seminola Boulevard based on the findings of fact and conclusions of the staff report dated July 11, 2019, and the seven (7) conditions of approval outlined in the staff report including Attachment A. Mr. Bakalla seconded the motion. The motion passed unanimously by voice vote.
