Planning & Zoning Commission/ <br />Local Planning Agency Minutes <br />July 10, 2019 <br />Page 3 <br />Mr. Dean Fathelbab, Planner ll, reviewed the information provided in his memos dated July 10, 2019 to the <br />City of Casselberry Planning and Zoning Commission. Mr. Fathelbab said staff recommends the Planning and <br />Zoning Commission approve CU 19-12 to operate a daycare facility at 1300 Seminola Boulevard. He said staffs <br />recommendation is based on the findings of fact and conclusions of the staff report dated July 11, 2019, and the <br />seven (7) conditions of approval including Attachment A. The conditions of approval are: <br />1. The conditional use shall be limited to the location of 1300 Seminola Boulevard. <br />2. The business shall remain in complete compliance with all City, County and State requirements. <br />3. There shall be no outside display or storage of goods, materials, services, or vehicles. <br />4. All applicable licenses and permits shall be obtained prior to the commencement of any business <br />activities at the site. <br />5. The conditional use shall commence within one year of approval. <br />6. A new conditional use application shall be required if the use should cease for more than 90 days. <br />7. All of the above conditions shall be fully and faithfully executed or the conditional use shall become null <br />and void. <br />A brief discussion ensued regarding the parking waivers and the St. Johns River Water Management District <br />permit. Mr. Henson explained these are site plan items and would be discussed during the site plan review portion of <br />the meeting. <br />In response to the Commission's question, Mr. Fathelbab explained that the project would require platting of <br />the property to aggregate the four lots. Mr. Fathelbab stated that it is more efficient to approve the site plan prior to <br />replatting the property. <br />Mr. Henson asked the applicant to come forward. Mr. Robert Ziegenfuss, 708 East Colonial Drive, Orlando, <br />Florida came forward. There were no questions for the applicant. <br />Mr. Henson asked if there was anyone in the audience who wished to speak in favor of, or in opposition to, <br />the request. No one came forward. <br />Mr. Henson asked for a motion to address CU 19-12. Mr. Hale made a motion that the Planning and Zoning <br />Commission approve CU 19-12 to operate a daycare facility at 1300 Seminola Boulevard based on the findings of <br />fact and conclusions of the staff report dated July 11, 2019, and the seven (7) conditions of approval outlined in the <br />staff report including Attachment A. Mr. Bakalla seconded the motion. The motion passed unanimously by voice <br />vote. <br />
