Planning & Zoning Commission/ <br />Local Planning Agency Minutes <br />June 12,2019 <br />Page 7 <br />ordinary high water line (OHWL) requirement. Mr. Fathelbab explained that the abutting land uses are medium <br />density multi -family development, which is suitable for condominiums. <br />Mr, Fathelbab said there has been some concerns mentioned at tonight's meeting regarding the buffer. He <br />explained that the buffer is not being reduced. He said the required buffer from the adjoining use is not being <br />impacted. He stated that the buffer yard is smaller than the required building setback. He said the softening of the <br />property line is still there and not impacted by the applicant's request. Mr. Fathelbab said that the current zoning and <br />future land use are compatible with the surrounding uses, <br />In response to the Commission's question, Ms. Fathelbab reviewed the minimum living area for a three- <br />bedroom townhome, the impervious surface area requirements for the RMF -13 zoning district, and the impervious <br />surface area calculations for this project. A general discussion ensued regarding the unit size, the design of the <br />ingress/egress for the project, fire truck access to the site, and the encroachment in to the setback. <br />Mr. Henson asked for a motion to address BA 19-02. Mr. Hale made a motion that the Planning and Zoning <br />Commission acting as the Local Planning Agency grant the side interior and rear lot line setback variance, BA 19-02, <br />for the property located at 547 Lake Howell Road based upon the Planning and Zoning Commission's findings of fact <br />and conclusions, the staff report dated June 12, 2019, and the three (3) conditions outlined in the staff report <br />including Attachments A — C. Mr. Bakalla seconded the motion. The motion passed with a majority vote with Mr. <br />Phillips and Mr. Bowman casting the dissenting votes. <br />Ninth Item of Business: SPR 19-03: 547 Lake Howell Road (Lake Howell Crossing — Townhomes). A major <br />site plan request to develop an 8 -unit townhouse subdivision. <br />Mr. Dean Fathelbab, Planner II, reviewed the information provided in his memorandum dated June 12, 2019 <br />to the City of Casselberry Planning and Zoning Commission. Mr. Fathelbab said staff requests the Planning and <br />Zoning Commission approve the major site plan application for the 547 Lake Howell Road (Lake Howell Crossing — <br />Townhomes) (SPR 19-03). He said the recommendation is based on the findings of fact and conclusions of the staff <br />report dated June 12, 2019, and subject to the six (6) conditions outlined in the staff report. The conditions of <br />approval are: <br />1. The applicant is required to get Planning and Zoning Commission approval for a variance to allow the <br />proposed encroachments into the required lot line setbacks. <br />
