Planning & Zoning Commission/ <br />Local Planning Agency Minutes <br />June 12, 2019 <br />Page 5 <br />In response to the Commission's question regarding any easements, Mr. Bowley stated there were no utility <br />easements located under the deck. <br />Mr. Henson asked the applicant to come forward. Mr. Shawn Whitaker, 345 Piney Ridge Road, <br />Casselberry, Florida came forward. In response to the Commission's question, Mr. Whitaker stated he grew up in <br />that house and his stepfather built the original deck several years ago. <br />Mr. Henson asked if there was anyone in the audience who wished to speak in favor of, or in opposition to, <br />the request. No one came forward. <br />Mr. Henson asked for a motion to address BA 19-03. Mr. Hale made a motion that the Planning and Zoning <br />Commission acting as the City's Local Planning Agency, approve the variance request BA 19-03 for a deck at 345 <br />Piney Ridge Road based on the two (2) conditions outlined in the June 12, 2019 staff report including Attachments A <br />& B. Mr. Phillips seconded the motion. The motion passed unanimously by voice vote. <br />Mr. Bowley excused himself from the meeting at 7;10 p.m. <br />Eighth Item of Business: BA 19-02: 547 Lake Howell Road. A variance request to Section 2-5.4 to reduce the <br />side interior lot line setback from 15 -ft. to 10 -ft. and reduce the rear lot line setback from 30 -ft. to 20 -ft. for a <br />proposed 8 -unit townhouse subdivision. <br />Mr. Dean Fathelbab, Planner II, reviewed the information provided in his memorandum dated June 12, 2019 <br />to the City of Casselberry Planning and Zoning Commission. Mr. Fathelbab said the variance application meets all <br />eleven (11) criteria for granting the variance; therefore, staff supports the variance request as presented. He said if <br />the Planning and Zoning Commission chooses to grant the side interior and rear lot line setback variance, BA 19-02, <br />for the property located at 547 Lake Howell Road, the motion should be based upon the Planning and Zoning <br />Commission's findings of fact and conclusions, the staff report dated June 12, 2019, and the three (3) conditions <br />outlined in the staff report. <br />A brief discussion ensued regarding the buffer from the adjoining uses. In response to the Commission's <br />question, Mr. Fathelbab explained there was a scrivener's error on the application regarding the size of the requested <br />variance. A brief discussion ensued regarding the placement of the visitor parking in the setback. In response to the <br />Commission's question, Mr. Fathelbab stated there is no requirement in the City Code to provide the four (4) visitor <br />parking spaces. <br />
