Planning & Zoning Commission/ <br />Local Planning Agency Minutes <br />June 12, 2019 <br />Page 4 <br />the Commission's question regarding medical services on site, Mr. Gabriel said that he has a veterinarian on call. A <br />general discussion ensued regarding the type of training that would be provided at the site. <br />Mr. Henson asked if there was anyone in the audience who wished to speak in favor of, or in opposition to, <br />the request. No one came forward. <br />Mr. Henson asked for a motion to address CU 19-09. Mr. Hale made a motion that the Planning and Zoning <br />Commission approve CU 19-09 to operate a dog training facility without outside kennels at 591 State Road 436 <br />based on the findings of fact and conclusions of the staff report dated June 12, 2019, and the ten (10) conditions <br />outlined in the staff report including Attachment A. Mr. Bowman seconded the motion. The motion passed <br />unanimously by voice vote. <br />Mr. Tardif excused himself from the meeting at 7:00 p.m. <br />Seventh Item of Business: BA 19-03: 345 Piney Ridge Road. A variance request to Section 2-5.4, Table 2-5.4 <br />of the ULDR to reduce the 10 -ft. side interior yard and 204 rear yard setbacks to 04 to allow a deck. <br />Mr. Chris Bowley, Community Development Director, reviewed the information provided in his memorandum <br />dated June 15, 2019 to the Casselberry Planning and Zoning Commission. Mr. Bowley said the variance application <br />for a deck at 345 Piney Ridge Road (BA 19-03) meets the eleven "test of variance" criteria listed above for granting a <br />variance to the City's zoning ordinance and pertaining to setback variance requests. He said due to the criteria <br />review and the physical constraints presented on-site, staff supports the variance request, as presented. Mr. Bowley <br />said staff further recommends that the Planning and Zoning Commission, serving as the City's Local Planning <br />Agency, approve the variance request, subject to the following conditions of approval: <br />1. The variance approval is only for the existing deck, as constructed, and no alterations, modifications, <br />extensions, or variations are made to the deck. In the event that alterations, modifications, extensions, or <br />variations are made to the deck, the deck shall be removed by the applicant to the conforming setback lines <br />of the underlying zoning district, as it may be amended from time to time, if possible, and within 60 -days of <br />the date of the deck's alteration. <br />2. A building permit is issued, pending approval of BA 19-03 for the variance application. In the event that the <br />variance request for BA 19-03 is not granted, the building permit application on -file will be closed and the <br />deck removed by the applicant to the conforming setback lines of the underlying zoning district within 60 - <br />days of the decision from the Planning and Zoning Commission. <br />Mr. Bowley stated that two emails have been provided to the Planning and Zoning Commission from two of <br />the adjacent neighbors supporting the variance request (copies are attached and made a part of the minutes). <br />
