Planning & Zoning Commission/ <br />Local Planning Agency Minutes <br />June 12, 2019 <br />Page 3 <br />Mr. Henson asked for a motion to address SP 19-01. Mr. Phillips made a motion that the Planning and <br />Zoning Commission provide a recommendation of approval to the City Commission for SP 19-01, Jefferson Lake <br />Howell, final plat, based upon the revised plat, Attachment B, the findings of fact and conclusions of the staff report <br />dated June 12, 2019, and the three (3) conditions outlined in Addendum A including Attachments A & B. Ms. <br />Costello seconded the motion. The motion passed unanimously by voice vote. <br />Sixth Item of Business: CU 19-09: 591 State Road 436. A conditional use request to operate a dog training <br />facility at 591 State Road 436. <br />Mr. Jonathan Tardif, Planner I, reviewed the information provided in his memorandum dated June 12, 2019 <br />to the City of Casselberry Planning and Zoning Commission. Mr. Tardif said staff recommends the Planning and <br />Zoning Commission approve CU 19-09 to operate a dog training facility without outside kennels at 591 State Road <br />436. He said staff's recommendation is based on the findings of fact and conclusions of the staff report dated June <br />12, 2019, and the following conditions: <br />1. The conditional use shall be limited to the location of 591 State Road 436. <br />2. The business shall remain in complete compliance with all City, County and State requirements. <br />3. An engineering permit shall be obtained and the parking lot shall be re -striped to meet the minimum <br />required parking of 11 parking spaces, 1 of which is ADA compliant. Any additional work that proposes <br />to modify the existing site plan shall require site plan review. <br />4. There shall be no outside display or storage of goods, materials, services, or vehicles. <br />5. All overnight boarding of animals shall occur indoors. The use of outdoor kennels is prohibited. <br />6. The business shall remain in continuous compliance with Chapter 20 of the Seminole County Code of <br />Ordinances. Any violation of Chapter 20 shall constitute eligibility to have the business license revoked. <br />7. All applicable licenses and permits shall be obtained prior to the commencement of any business <br />activities at the site. <br />8. The conditional use shall commence within 180 days of approval. <br />9. A new conditional use application shall be required if the use should cease for more than 90 days. <br />10. All of the above conditions shall be fully and faithfully executed or the conditional use shall become null <br />and void. <br />A brief discussion ensued regarding the number of parking spaces required for this use, the location of <br />outside fenced area for the dogs and ADA parking requirements. <br />Mr. Henson asked the applicant to come forward. Mr. Laurent Gabriel, 591 State Road 436, Casselberry, <br />Florida came forward. In response to the Commission's questions, Mr. Gabriel stated that the fenced dog area would <br />be located on the south side (rear) of the property and there would be no sale of animals on the site.
