Planning & Zoning Commission/ <br />Local Planning Agency Minutes <br />May 8, 2019 <br />Page 3 <br />Mr. Henson asked for a motion to address ZB 19-04. Ms. Campbell made a motion that the Planning and <br />Zoning Commission provide a recommendation of denial to the City Commission for ZB 19-04 to amend the Official <br />Zoning Map from CG (Commercial General) to PMX-MID (Planned Mixed -Use: Medium Rise) for the subject property <br />generally located at the southeast corner of Oxford Road and State Road 436 based on the findings of fact and <br />conclusions of the staff report dated May 8, 2019, and the two findings listing in the staff report including Attachments <br />A — C. Mr. Hale seconded the motion. The motion passed unanimously by voice vote. <br />Mr. Henson excused Ms. Reischmann from the meeting. <br />Sixth Item of Business: CU 19-08: 853 SR 436. A conditional use request to operate an educational institution <br />at 853 State Road 436. <br />Mr. Jonathan Tardif, Planning Technician, stated that the applicant has withdrawn his application. <br />Seventh Item of Business: CU 19-10: 2054 SR 436 Unit 112. A conditional use request to allow the sale and <br />onsite consumption of beer and wine (2COP) at the property located at 2054 State Road 436 unit #112. <br />Mr. Jonathan Tardif, Planning Technician, reviewed the information provided in his memorandum dated May <br />8, 2019, to the City of Casselberry Planning and Zoning Commission. Mr. Tardif said staff recommends the Planning <br />and Zoning Commission approve CU 19-10 to allow the sale of beer and wine (2COP) for on-site consumption at <br />2054 State Road 436 unit #112. He said staffs recommendation is based on the findings of fact and conclusions of <br />the staff report dated May 8, 2019, and the following conditions: <br />1. The conditional use shall be limited to the location of 2054 State Road 436, Unit #112 as indicated in <br />Attachment C. The conditional use does not apply to the other tenant spaces or buildings on the <br />property. <br />2. All sales and consumption of alcoholic beverages shall be on-site and within the tenant space. <br />3. Package sales of alcoholic beverages for off-site consumption shall be prohibited. <br />4. The hours of on-site alcohol consumption and sales shall comply with the hours set forth in Sec. 10-2 of <br />the City of Casselberry's Code of Ordinances. <br />5. The business shall remain in complete compliance with all City, County and State requirements. <br />6. There shall be no outside display or storage of goods, materials, services, or vehicles. <br />7. The conditional use shall commence within 120 days of approval. <br />8. All applicable licenses and permits shall be obtained prior to the commencement of any business <br />activities at the site. <br />9. A new conditional use application shall be required if the use should cease for more than 90 days. <br />10. All of the above conditions shall be fully and faithfully executed or the conditional use shall become null <br />and void. <br />In response to the Commission's question, Mr. Tardif said there would be no outside seating. <br />
