Planning & Zoning Commission/ <br />Local Planning Agency Minutes <br />May 8, 2019 <br />Page 2 <br />Fourth Item of Business: Disclosure of Ex Parte Communications. <br />No disclosure of Ex Parte Communications was made by the Commissioners. <br />The agenda order was modified. <br />Fifth Item of Business: ZB 19-04: Official Zoning Map Amendment. A request to amend the Official Zoning <br />Map from CG (Commercial General) to PMX-MID (Planned Mixed -Use: Medium Rise) for the property <br />generally located at the southeast corner of Oxford Road and SR 436. <br />Ms. Christina Hyson, Planner I, reviewed the information provided in her memorandum dated May 8, 2019, <br />to the City of Casselberry Planning and Zoning Commission. Ms. Hyson said staff recommends that the Planning <br />and Zoning Commission provide a recommendation of denial to the City Commission for ZB 19-04 to amend the <br />Official Zoning Map from CG (Commercial General) to PMX-MID (Planned Mixed -Use: Medium Rise) for the subject <br />property generally located at the southeast corner of Oxford Road and State Road 436. She said staffs <br />recommendation is based on the findings of fact and conclusions of the staff report dated May 8, 2019, and the <br />following findings regarding the proposed change to the Official Zoning Map: <br />1. The requested amendment to the Official Zoning Map does not conform to Policies 1.5 and 8.2 of the Future <br />Land Use Element of the Comprehensive Plan, and does not comply with Section 2-4.3, Section 2-4.4, and <br />Section 2-5.2 of the City's Unified Land Development Regulations; and <br />2. The requested amendment to the Official Zoning Map is not consistent with the orderly development of land <br />use patterns. <br />In response to the Commission's question regarding if there has been any recent instances of properties <br />with a split zoning within a parcel, Ms. Hyson said she was not aware of any. She said there are instances where the <br />Seminole County Property Appraiser's Office combined properties without staffs knowledge. She said there has <br />been some inconsistencies that were found later that the zonings were different. In response to the Commission's <br />question, Ms. Hyson said in those cases staff would support having a uniformed designation across the property. <br />A general discussion ensued regarding the subject property not having direct access to State Road 436. <br />Ms. Reischmann explained that this is a lot split and there would be no recorded easement because it is one lot. <br />Mr. Henson asked the applicant to come forward. Mr. Spencer Bass, RaceTrac representative came <br />forward. Mr. Bass said RaceTrac is no longer interested in pursuing the rezoning application. <br />Mr. Henson asked if there was anyone in the audience who wished to speak in favor of, or in opposition to, <br />the request. No one came forward. <br />
