potential fire hazard, and Code Enforcement has done about everything they can, but waiting another month or two is
<br />unacceptable to Mr. Lutz. Mr. Lutz continued.
<br />The Special Magistrate asked Supervisor Campbell to explain, for the record the abatement process procedure, and what
<br />it will address. Supervisor Campbell, clarified that the pool case was heard at the previous meeting, and unfortunately,
<br />there has been a change of ownership. When a change of ownership happen, the process has to start over in the case. The
<br />wife passed away and the husband has heath issues, Supervisor Campbell did meet the husband at the property where
<br />there was a POD in the front yard. The POD was for items coming out of the house, this has now been removed.
<br />Supervisor Campbell advised that the property has been cited for open and abandoned, this will take at least sixty days
<br />with the SUBAC code, to go through the process legally. The Special Magistrate asked if the pool was a $250 per day
<br />fine. Supervisor Campbell stated it was $250 per day. The Special Magistrate stated this is a balancing act, when it comes
<br />to Code Enforcement. A property (like this) is terrible; the owner of the property is still entitled to due process.
<br />The Special Magistrate made a finding that CE -19-001281, located at 1523 Canterbury Cir., was in violation of City Code
<br />Section 1-4.1, 3-10.3.b.1 and 3-10.3.c.1, based on testimony and evidence provided by the Code Enforcement Officer. It
<br />was ordered that the respondent shall cure the violation by 1:00 P.M. October 31, 2019. If there is no compliance by
<br />October 31, 2019, then a fine of $250.00 per day will be imposed for each day the property remains in non-compliance.
<br />A subsequent hearing will be held on November 14, 2019, to determine if compliance has been achieved.
<br />The Special Magistrate came back to this case, and stated that this property was shocking. This case may have been set
<br />for a compliance date of October 31, 2019, when it was meant to be September 31(30"'), 2019. The updated compliance
<br />date for 1523 Canterbury Cir. was now September 30, 2019, with a subsequent hearing to determine compliance to be
<br />held on October 12, 2019. The fine about remained at $250 per day, if there is no compliance.

<br />Officer Eastwood, provided testimony, and advised the property was not in compliance as of September 5, 2019. The
<br />Special Magistrate asked for verification if this was a $250 per day fine, and if there has been any contact from Wells
<br />Fargo. Officer Eastwood stated there has been only email; they are stating they are not responsible.
<br />The Special Magistrate asked if anyone was present to speak for this case; Victor Lutz was present to speak. Mr. Lutz,
<br />1478 Lady Amy Dr, Casselberry, FL stated this was a safety and fire hazard to the men and woman who live in this
<br />section. This is also a danger to children and disease, and waiting until any day after September 13, 2019 to clean it up is
<br />a danger. Mr. Lutz stated he wanted to go on record that is the responsibility of Wells Fargo and whoever is in charge to
<br />clean the mess up. Mr. Lutz continued.
<br />Supervisor Campbell advised that they do have to go through the process, and the way it is set up, they have to wait sixty
<br />days to abate the property. They City can then secure the garage and address the pool as well. The Special Magistrate
<br />asked if that would be another lien on the property. Supervisor Campbell advised it would be a hard cost lien.
<br />The Special Magistrate found the property located at 1523 Canterbury Cir, in violation of the City Codes as listed in the
<br />Notice of violation, it was found that the property remains in non-compliant as of the date set for compliance. A fine/lien
<br />of $250 per day, from the date set in the Findings of Fact. The fine/lien will run until there is compliance, at $250 per day.
<br />A health and safety tag was also issued by the Special Magistrate for the pool.

<br />a fine of $50.00 per day should then be imposed for each day of non-compliance thereafter. The City requests a subsequent
<br />hearing date of November 14, 2019, to determine compliance.
