Brian Hitchcock, facilities manager for the plaza, stated an escape room went in to the space where a furniture store used <br />to be. Mr. Hitchcock thought the September 12, 2019 hearing was the initial hearing, and not the fine hearing, he then <br />stated he would personally pay the fine. <br />The Special Magistrate stated she would reduce the fine amount, however, there was staff time, and hearing time involved. <br />The reduction would be 50% of the fine amount. Officer Alcuri advised the Special Magistrate that the fine was $50 per <br />day. The Special Magistrate advised that the fine would be $150. <br />NEW CASES <br />CE -19-001191 1586 Hilltop Dr. <br />• No building permit, ULDR Section 1-4.3.a <br />Officer Eastwood, provided testimony and read case information into record. If no compliance by October 12, 2019, then <br />a fine of $100.00 per day should then be imposed for each day of non-compliance thereafter. The City requests a <br />subsequent hearing date of November 14, 2019, to determine compliance. Officer Eastwood advised that a building permit <br />would be needed to make changed inside the mobile home, and a conversation was had with the property owner on June <br />25, 2019. As of September 12, 2019, a permit has not been obtained. <br />The Special Magistrate asked if anyone was present to speak for this case; there was a representative present. <br />Robert Barrett, 1586 Hilltop Rd., advised that when he received the violation for bushes laying on the ground, skirting <br />(was falling apart) and there was leak. There were just repairs being made, nothing structural. Officer Eastwood advised <br />Mr. Barrett to get a structural engineer to verify the unit was structurally sound, and there were no changed they could <br />proceed and put paneling back up. Drywall had been in the process of being put back up. <br />Discussion ensued. <br />The Special Magistrate made a finding that CE -19-001191, located at 1586 Hilltop Dr., was in violation of City Code <br />Section 1-4.3.a, based on testimony and evidence provided by the Code Enforcement Officer. It was ordered that the <br />respondent shall cure the violation by 1:00 P.M. October 31, 2019. If there is no compliance by October 31, 2019, then a <br />fine of $100.00 per day will be imposed for each day the property remains in non-compliance. A subsequent hearing will <br />be held on November 14, 2019, to determine if compliance has been achieved. <br />CE -19-001281 1523 Canterbu Cir. <br />• Damaged windows, skylights, doors; City code 1-4.1 <br />• Fence in disrepair, City code 3-10.3.b.1 <br />• Overgrowth, weeds, trash and debris, ULDR Section 3-10.3.c.1 <br />Officer Eastwood, provided testimony and read case information into record. The Special Magistrate asked if the garage door <br />was shut and all of the stuff was inside, would it still be in violation? Officer Eastwood stated if you cannot see it, you <br />cannot see it, but there are other issues. <br />Discussion ensued. <br />The Special Magistrate asked if anyone was present to speak for this case; there was someone present to speak to this <br />case. Victor Lurt, 1478 Lady Amy Dr, a resident of Casselberry on and off for thirty-one years. Mr. Lutz understood the <br />legal proceeding, and that it was looked at on July 9, 2019 and August 13, 2019. The property has been in this condition <br />for over a year, and for those not aware there was a terrible fire down the street, which decimated the home. <br />Mr. Lutz stated this property needs immediate attention and why there has not been a fire is an act of God. The property <br />us unsafe, there is leaking garbage, unsafe for children, unsafe for property values, and is owned by one of the richest <br />banks in the country.
