The Special Magistrate entered into record an order setting trial for August 22, 2019, marked as Exhibit A. Mr. Smith
asked for an extension to the end of September (2019) to secure a contractor.
The Special Magistrate made a finding that CE -19-000204, located at 581 Queens Mirror Cir., was in violation of City
Code Section 3-10.3.a.1, based on testimony and evidence provided by the Code Enforcement Officer. It was ordered that
the respondent shall cure the violation by 1:00 P.M. October 1, 2019. If there is no compliance by October 1, 2019, then
a fine of $250.00 per day will be imposed for each day the property remains in non-compliance. A subsequent hearing
will be held on October 10, 2019, to determine if compliance has been achieved.
CE -19-000660 605 Brittany Ct.
• Swimming pool standards, ULDR Section 3-10.3.C.7
Officer Acevedo, provided testimony and read case information into record. The City requested a correction date of
08/22/2019. If no compliance by 08/22/2019, then a fine of $100.00 per day should then be imposed for each day of non-
compliance thereafter. The City requested a subsequent hearing date of 09/12/2019 to determine compliance.
Daniel Lynch, 605 Brittany Ct. advised he had a statement from his pool cleaner for at least two months. The pool was
dirtier than what was first thought and should be done in a month.
The Special Magistrate asked if there was a letter from the pool company. Mr. Lynch stated he had an invoice.
The Special Magistrate entered into record and invoice from Life's a Pool, marked as Exhibit A. Officer Acevedo advised
that she has been working with the homeowner.
The Special Magistrate made a finding that CE -19-000660, located at 605 Brittany Ct., was in violation of City Code
Section 3-10.3.C.7, based on testimony and evidence provided by the Code Enforcement Officer. It was ordered that the
respondent shall cure the violation by 1:00 P.M. September 10, 2019. If there is no compliance by September 10, 2019,
then a fine of $100.00 per day will be imposed for each day the property remains in non-compliance. A subsequent hearing
will be held on September 12, 2019, to determine if compliance has been achieved.
CE -19-000258 873 E 436 SR #891
• Roofs, gutters, down spout maintenance, ULDR Section 3-10.3.a.4
Supervisor Campbell, advised he has been working with the property owner. The contractor is on site and working but
will take a while due to the size of the roof.
The Special Magistrate asked if staff had a recommendation on an extension of time. Supervisor Campbell advised it may
take until the end of the month (August) to complete.
Miwana Shelvo, representative for Rio Bello Investments, advised an agreement was made with Atlantic Insurance and
she left (the property) on July 31, 2019. The roof is being worked on and is about 60% complete. Collis Roofing should
be done by August 23, 2019, as weather permits.
The Special Magistrate made a finding in CE -19-000258, located at 873 E 436 SR #891 to extend the compliance date on
the order to September 10, 2019. If the property owner comes back after September 10, 2019, for more time, it would be
unlikely there would be another extension granted.
NEW CASES WITHDRAWN DUE TO COMPLIANCE
19-000449 416 Bridle Path
19-000828 3068 Autumn Ct.
19-001180 1465 Guinevere Dr.
19-001157 260 Mockingbird Ln.
3 1 P a g e
