Officer Alcuri advised the violation was for window sign violations. Everyone complied in the building, except for the <br />law firm. The business had more than the 25% window coverage allowed by the City. There was email correspondence <br />and the application provided to the violator by Officer Alcuri. The application was submitted at the end of July (2018) <br />and was not approved until August 6, 2018, and took until August 15, 2018, to remove the signage to come into <br />compliance. <br />The Special Magistrate asked what the fine imposed was. Officer Alcuri advised that fine was $1,760.00. <br />Discussion ensued. <br />The Special Magistrate made a finding in CE -1 8-000741, located at 2050 SR 436 to deny the request to reduce the lien. <br />A break was taken at 6:44 P.M. due to technical issues. <br />Meeting started back at 6:52 P.M. <br />NEW CASES <br />CE -19-000024 1041 8TH St. <br />• Unsafe buildings or systems, City Code Section 1-4.4 (FBC 103.5) <br />Officer Eastwood, provided testimony and read case information into record. The City requested a correction date of <br />09/07/2019. If no compliance by 09/07/2019, then a fine of $250.00 per day should be imposed for each day of non- <br />compliance thereafter. The City requested a subsequent hearing date of 09/12/2019 to determine compliance. <br />Richard Casselberry, 413 Bridle Path, representing Sherwood Forest, LLC, gave testimony. The case went back several <br />months, but it was not as if they have not been doing things all along. An engineer was consulted about doing repairs; <br />the damage was from a past tropical storm. <br />The Special Magistrate asked what the specific damage was. Mr. Casselberry advised it was a hole in the roof. It was <br />decided not to do repairs and Mr. Casselberry was going to obtain a demolition permit. The contractor pulled the permit <br />and the home will be demolished. <br />Discussion ensued. <br />The Special Magistrate made a finding that CE -19-000024, located at 1041 8TH St., was in violation of City Code Section <br />1-4.4 (FBC 103.5), based on testimony and evidence provided by the Code Enforcement Officer. It was ordered that the <br />respondent shall cure the violation by 1:00 P.M. September 12, 2019. If there is no compliance by September 12, 2019, <br />then a fine of $250.00 per day will be imposed for each day the property remains in non-compliance. A subsequent hearing <br />will be held on September 12, 2019, to determine if compliance has been achieved. <br />CE -19-000204 581 Queens Mirror Cir. <br />0 Buildings and accessory structure painting, ULDR Section 3-10.3.a.I <br />Officer Eastwood, provided testimony and read case information into record. The City requested a subsequent hearing date of 9/12/2019 to determine compliance. <br />The Special Magistrate asked if anyone had looks at this for structural concerns. Officer Eastwood stated no. <br />Randall Smith, 581 Queens Mirror Cir. advised the property has been appraised and there is no structural damage, just <br />cosmetic.
