Ordinance 20-1535 —Voluntary Annexation of 3110 Howell Branch Road and 3128 <br />Orava Lane <br />The City Attorney read Ordinance 20-1535 by title, as follows: <br />"AN ORDINANCE OF THE CITY OF CASSELBERRY, FLORIDA, RELATING TO <br />VOLUNTARY ANNEXATION; MAKING FINDINGS; ANNEXING TO AND INCLUDING <br />WITHIN THE CORPORATE LIMITS OF THE CITY OF CASSELBERRY, FLORIDA, CERTAIN <br />LANDS GENERALLY LOCATED IN SECTION 34, TOWNSHIP 21 SOUTH, RANGE 30 EAST <br />AT 3110 HOWELL BRANCH ROAD AND 3128 ORAVA LANE; REDEFINING THE <br />CORPORATE LIMITS OF THE CITY OF CASSELBERRY, FLORIDA; PROVIDING FOR THE <br />INTERIM PROVISION OF LAND DEVELOPMENT REGULATIONS; PROVIDING THAT, <br />EFFECTIVE IN ACCORDANCE WITH LAW, THE PROPERTY TO BE ANNEXED SHALL BE <br />ASSESSED FOR PAYMENT OF MUNICIPAL AD VALOREM TAXES; DIRECTING THE CITY <br />CLERK TO FILE COPIES OF THE ORDINANCE WITH THE SEMINOLE COUNTY CLERK <br />OF THE CIRCUIT COURT, THE CHIEF ADMINISTRATIVE OFFICER OF SEMINOLE <br />COUNTY, AND THE FLORIDA DEPARTMENT OF STATE; AND PROVIDING FOR <br />CONFLICTS, SEVERABILITY, AND EFFECTIVE DATE." <br />Staff Presentation: Community Development Director Chris Bowley stated Ordinance 20-1535 provides <br />for the voluntary annexation of two (2) properties located at 3110 Howell Branch Road and 3128 Orava <br />Lane consisting of approximately 18.25 acres. The current owner of the subject parcels is the not-for-profit <br />corporation Slovak Gardens, A Home for American Slovaks, Inc. The subject properties have a Seminole <br />County Future Land Use Map (FLUM) designation of High Density Residential and an R-4 (Multifamily) <br />zoning district. The parcels proposed for annexation are contiguous to the municipal boundary; are well- <br />defined and are a compact area; are not included within the boundary of any other municipality; and do not <br />create a pocket or enclave. The City followed the notification requirements of Section 171.004, Florida <br />Statutes as follows: a) Seminole County was notified of the City's intent at least ten (10) days prior to <br />advertising the action for City Commission approval; b) City Commission first reading is scheduled on July <br />27, 2020; c) if approved on first reading, Notice of Public Hearing will be placed in the Orlando Sentinel <br />for two consecutive weeks (August 13, 2020 and August 20, 2020) prior to the City Commission adoption <br />hearing on August 24, 2020; d) after adoption, the City Clerk will notify the Seminole County Clerk of the <br />Circuit Court, the Chief Administrative Officer of the County, and the Department of State within seven <br />(7) days of the adoption. Once the properties are annexed into the City, the properties will be provided a <br />City Future Land Use Map and Zoning designation similar to the adjacent properties. <br />Budget Impact: There is no impact to the City Budget. <br />Recommendation: The City Manager and the Community Development Director recommended approval <br />of Ordinance 20-1535 on first reading. <br />Audience Participation: No one came forward to address Ordinance 20-1535. <br />
