CASSELBERRY CITY COMMISSION <br />Minutes of June 22, 2020 — Regular Meeting <br />Page 8 of ] 2 <br />Budget Impact: There is no impact to the City Budget. <br />Recommendation: The City Manager and the Administrative Services Director recommended approval <br />of Resolution 20-3166 and the Procurement Policy. <br />Audience Participation: No one came forward to address Resolution 20-3166. <br />MOTION: Commissioner Busch moved to approve Resolution 20-3166, as presented. <br />Motion was seconded by Vice Mayor Hufford. Motion carried unanimously by <br />voice vote 5-0. <br />C. Resolution 20-3169 — Model Home Aueement with Meritage Homes of Florida <br />Inc. for Legacy Place Townhomes <br />The City Clerk read Resolution 20-3169 by title, as follows: <br />"A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF CASSELBERRY, <br />FLORIDA, APPROVING A MODEL HOME AGREEMENT BETWEEN THE CITY OF <br />CASSELBERRY AND MERITAGE HOMES OF FLORIDA, INC. FOR THE LEGACY PLACE <br />TOWNHOMES DEVELOPMENT; PROVIDING FOR CONFLICTS, SEVERABILITY, AND AN <br />EFFECTIVE DATE." <br />Staff Presentation: Community Development Director Chris Bowley stated that Resolution 20-3169 <br />authorizes a Model Home Agreement with Meritage Homes of Florida, Inc. for Legacy Place Townhomes. <br />Discussion: Resolution 20-3169 provides for approval of a Model Home Agreement similar to past <br />agreements for residential development within the City. Whereas Unified Land Development Code Section <br />4-19.1.G requires the final plat to be recorded prior to issuing building permits, these model home <br />agreements have allowed developers to seek building permits for only the identified model center provided <br />all infrastructure is in place, requires the developer to complete the final plat, and holds the City harmless <br />of liability up to the final plat recordation. <br />Budget Impact: There is no budget impact to the City. <br />Recommendation: The City Manager and the Community Development Director recommended approval <br />of Resolution 20-3169. <br />Audience Participation: The following individual came forward to address Resolution 20-3169: <br />Mr. Philip Kaprow of Kilgore, Pearlman, Semanie, Denius & Squires, P.A. 800 North <br />Magnolia Avenue, Suite 1500, Orlando, stated that he represented the land developer for this <br />project and expressed support for Resolution 20-3169. He added that he and his client had <br />worked with the City to get to this point, and he anticipated completing the platting process for <br />Commission approval within the next few months; however, getting the model home agreement <br />in place was needed in order to move forward with the project at this time. <br />
