CASSELBERRY CITY COMMISSION <br />Minutes of June 22, 2020 — Regular Meeting <br />Page 7 of 12 <br />LEGISLATIVE FINDINGS; RECOGNIZING LEGISLATION IN PROGRESS; PROVIDING FOR <br />CONFLICTS, SEVERABILITY, AND AN EFFECTIVE DATE." <br />Staff Presentation: Community Development Director Chris Bowley stated that Resolution 20-3165 <br />provides for establishing Legislation in Progress to amend Article II1, Development Agreements, Section <br />2-5.4, Size and Dimension Criteria, Table 2-5.4, and Article XX, Planned Unit Development. He added <br />that staff was preparing an ordinance to address issues with the Planned Unit Development process which <br />were discovered since the last legislation in progress resolution approved by the City Commission in <br />February of 2020. The ordinance will be presented to the City Commission for consideration at a future <br />meeting. <br />Budget Impact: There is no impact to the City Budget. <br />Recommendation: The City Manager and the Community Development Director recommended approval <br />of Resolution 20-3165. <br />Audience Participation: No one came forward to address Resolution 20-3165. <br />MOTION: Commissioner Aramendia moved to approve Resolution 20-3165, as presented. <br />Motion was seconded by Commissioner Meadows. Motion carried <br />unanimously by voice vote 5-0. <br />B. Resolution 20-31.66 — Procurement Policy <br />The City Clerk read Resolution 20-3166 by title, as follows: <br />"A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF CASSELBERRY, <br />FLORIDA, REPEALING RESOLUTION 15-2807, PURCHASING POLICY, AND RESOLUTION <br />08-1938, SALE OF SURPLUS REAL PROPERTY POLICY AND PROCEDURES; AND <br />CREATING AND IMPLEMENTING A NEW PROCUREMENT POLICY; PROVIDING FOR <br />CONFLICTS, SEVERABILITY AND EFFECTIVE DATE." <br />Staff Presentation: City Manager Randy Newlon stated that Resolution 20-3166 provides for the repeal <br />of Resolution 15-2807, Purchasing Policy, and Resolution 08-1938, Sale of Surplus Real Property Policy <br />and Procedures, in their entirety and adoption of a new Procurement Policy. Mr. Newlon advised this was <br />an update of the existing procurement policy with some significant changes that included: tying the policy <br />to State Statutes so the policy automatically changes with any changes to the Statutes to be in line with <br />those amendments; increases City Manager approval authority for small contract authorizations from <br />$50,000 to $65,000; increases Procurement Administrator authority for small contract authorizations from <br />$25,000 to $35,000; adds a new option for solicitation called Invitation to Negotiate; sets up a protest bond <br />procedure to discourage frivolous protests of solicitations; and merges into this policy the rules relating to <br />handling and marketing of surplus real property. In response to questions from the City Commission Mr. <br />Newlon explained that the updates to the policy were a result of staff research and were mainly to bring the <br />City's policies in line with requirements in the State Statutes. He added that the policies relating to surplus <br />real property were already in place, but were just being merged into this larger policy, including raising of <br />the thresholds relating to the land area and dollar value for requiring professional appraisal of the property. <br />
