Motion was seconded by Commissioner Busch. <br />Motion carried unanimously by voice vote 5-0. <br />B. Ordinance 20-1534 — Amending Chapter 70 Solid Waste of the City Code of <br />0rdinnn(,.es_ <br />The City Clerk read Ordinance 20-1534 by title, as follows: <br />"AN ORDINANCE OF THE CITY OF CASSELBERRY, FLORIDA, AMENDING THE CITY <br />CODE OF ORDINANCES, PART II, CHAPTER 70 — SOLID WASTE, SECTION 70-1 TO <br />SECTION 70-100 PROVIDING FOR CODIFICATION, CONFLICTS, SEVERABILITY, AND AN <br />EFFECTIVE DATE." <br />Notice of Public Hearing: The Notice of Public Hearing relative to Ordinance 20-1534 was advertised in <br />the Orlando Sentinel on Thursday, May 28, 2020. <br />Staff Presentation: City Manager Randy Newlon stated that Ordinance 20-1534 provides for amendments <br />to Chapter 70 Solid Waste of the City Code of Ordinances, primarily to establish an exclusive commercial <br />waste franchise system. It still provides for an exclusive contractor to perform residential solid waste <br />pickup services on behalf of the city. It also now includes elimination of the City's current non-exclusive <br />franchise system for commercial solid waste and switching to an exclusive franchise system, which would <br />grant through a competitive process: 1) one exclusive franchise to a commercial waste hauler for the <br />collection of all putrescible commercial waste within the City limits, which would include waste set out in <br />dumpsters, commercial carts, and roll -off compactors, and 2) one exclusive franchise to a commercial <br />waste hauler to collect all non-putrescible wastes set out in open -top roll -off containers within the City <br />limits. The ordinance will render the Code much more simplified as much of the detail previously placed <br />there will now be found in the individual, exclusive franchise agreements. <br />Mr. Newlon advised that the ordinance had been updated since its approval on first reading at the May 11, <br />2020 City Commission meeting to include a new Section II which addresses the transition of existing <br />franchise agreements to ensure a smooth transition period while the City switches to the new exclusive <br />system for commercial solid waste. Upon approval of Ordinance 20-1534 City staff will reach out to the <br />existing franchisees to request extension of their existing franchise agreements to December 31, 2020. <br />These extensions will be brought to the City Commission for approval at a future City Commission meeting, <br />tentatively July 2020. City staff also intends to release a solicitation for the exclusive commercial solid <br />waste agreements. Award of the new agreements is anticipated to be brought to the City Commission in <br />late summer of 2020. This will allow the City time to prepare for and execute the transition with various <br />parties, with the goal to fully complete the transition in early 2021. <br />Budget Impact: There is no impact to the City Budget. <br />Recommendation: The City Manager and the Public Works Director recommended adoption of <br />Ordinance 20-1534 on second reading. <br />
