CASSELBERRY CITY COMMISSION <br />Minutes of August 12, 2019 — Regular Meeting <br />Page 8 of 11 <br />Audience Participation: No one came forward to address Ordinance 19-1520. <br />MOTION: Commissioner Meadows moved to approve Ordinance 19-1520 on first <br />reading, as presented. Motion was seconded by Commissioner Busch. <br />Discussion: Discussion ensued regarding Ordinance 19-1520 which included: concerns expressed that the <br />City was attempting to solve a problem that did not currently exist with regard to the City's tree canopy; <br />utilization of the current policy of tree plantings in rights-of-way and incentivizing homeowners to allow <br />plantings of trees on private property to mitigate any detrimental effects of tree removals on the tree canopy; <br />concerns about property rights; current permit requirements and processes and when mitigation and/or <br />payment into the City's tree bank would be required; and feasibility of monitoring the tree removal situation <br />and reviewing it in possibly six months to a year to assess the impact, if any, the new legislation has had on <br />the City's tree canopy and the number of trees being removed. <br />Ms. Hanna advised that regardless of the outcome of first reading of Ordinance 19-1520, the City's Land <br />Development Code would have to be amended to comply with the passage of House Bill 1.529, so she would <br />either bring a new ordinance to the Commission in the future or a revised version of Ordinance 19-1520 for <br />second reading. <br />Motion failed unanimously by voice vote 0-5. <br />11. PUBLIC HEARINGS <br />A. Resolution 19-3113 — Street Lighting Final Assessment Resolution <br />The City Clerk read Resolution 19-3113 by title, as follows: <br />"A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF CASSELBERRY, <br />FLORIDA, RELATING TO THE DELIVERY AND FUNDING OF STREET LIGHTING <br />SERVICES WITHIN THE CITY; AMENDING, RATIFYING AND CONFIRMING THE <br />PRELIMINARY RATE RESOLUTION FOR FISCAL YEAR 2019-20 AND ALL PREVIOUSLY <br />IMPOSED STREET LIGHTING ASSESSMENTS, CHARGES AND FEES; DETERMINING <br />THAT CERTAIN REAL PROPERTY IS SPECIALLY BENEFITED BY STREET LIGHTING <br />SERVICES; APPROVING THE ASSESSMENT ROLL; PROVIDING THE METHOD OF <br />COLLECTION; AND PROVIDING FOR CONFLICTS, SEVERABILITY AND AN EFFECTIVE <br />DATE." <br />Notice of Public Hearing: The Notice of Public Hearing relative to Resolution 19-3113, Street Lighting <br />Final Assessment Resolution, was advertised in the Orlando Sentinel on Thursday, July 11, 2019. <br />Staff Presentation: Deputy Public Works Director/City Engineer Kelly Brock stated that Resolution 19- <br />3113 provides for the implementation of the street lighting service assessment for Fiscal Year 2019-20. <br />The rate is $31.88 per equivalent residential unit (ERU) and is the same rate per ERU as the previous year <br />assessed. The net estimated revenue for this assessment is budgeted in the proposed FY 2019-20 Budget <br />at approximately $380,000.00. <br />
