CASSCLBERRY CITY COMMISSION <br />Minutes of August 12, 2019 — Regular Meeting <br />Page 7 of 11 <br />The request to amend the Future Land Use Map from Industrial to Commercial for the subject property is: <br />consistent with the City's Comprehensive Plan; compatible with the surrounding mix of land uses and <br />zoning districts; and City water and sanitary sewer services are available to the subject property. <br />Budget Impact: There is no impact to the City Budget. <br />Recommendation: The City Manager and the Community Development Director recommended approval <br />of Ordinance 19-1519 on first reading. <br />Audience Participation: No one came forward to address Ordinance 19-1519. <br />MOTION: Commissioner Busch moved to approve Ordinance 19-1519 on first reading, <br />as presented. Motion was seconded by Commissioner Hufford. Motion <br />carried unanimously by voice vote 5-0. <br />B. Ordinance 19-1520 - Amending Article XIV Tree Protection (LPA 19-08) <br />The City Cleric read Ordinance 19-1520 by title, as follows: <br />"AN ORDINANCE OF THE CITY OF CASSELBERRY, FLORIDA, AMENDING THE CITY <br />CODE OF ORDINANCES, PART III, UNIFIED LAND DEVELOPMENT REGULATIONS, <br />ARTICLE XIV, TREE PROTECTION, SECTION 3-14.3 PERMIT REQUIRED FOR REMOVAL, <br />TO REMOVE THE PERMIT EXEMPTION FOR SINGLE FAMILY DWELLINGS AND <br />DUPLEXES; PROVIDING FOR CODIFICATION, CONFLICTS, SEVERABILITY, AND <br />EFFECTIVE DATE." <br />Staff Presentation: Development Services Manager Emily Hanna stated that Ordinance 19-1520 amends <br />Article XIV, Tree Protection, Section 3-14.3 to remove the tree removal permit exemption for single-family <br />and duplex dwellings and to incorporate language relating to House Bill (HB) 1159 which was signed into <br />law on July 1 , 2019 which exempts property owners from needing a tree removal permit or mitigation for <br />trees removed that are a danger to persons or property, or to prune or trim trees. <br />Discussion: A lengthy discussion ensued relating to Ordinance 19-1520, which included: effect of House <br />Bill 1159 (HB 1159) on the City's tree removal permitting process; whether there is evidence that the City's <br />tree canopy has been negatively impacted by tree removals; options for mitigation of loss of tree canopy <br />due to tree removals, including planting trees in rights-of-way and incentives for plantings on private <br />property; concerns about property rights; current cost and process for tree removal permits and potential <br />for increased staff workload if the ordinance is adopted; whether failure to adopt Ordinance 19-1520 would <br />encourage removal of trees without cause; intended purpose of the proposed ordinance and whether it is <br />actually necessary; and comparisons of tree removal permitting processes with surrounding cities. <br />Budget Impact: There is no impact to the City Budget. <br />Recommendation: The City Manager and the Community Development Director recommended approval <br />of Ordinance 19-1520 on first reading. <br />
