the procedures provided by the Ordinance, including the tax bill collection method for the Fiscal <br />Year beginning on October 1, 2019. <br />(F) Pursuant to the provisions of the Ordinance, the City Commission is required to <br />confirm or repeal the Initial Assessment Resolution with such amendments as the City <br />Commission deems appropriate after hearing comments and receiving objections from all <br />interested parties. <br />(G) On July 22, 2019, a public hearing was held and the City Commission adopted <br />Resolution 19-3107, the Initial Assessment Resolution for the Sausalito Assessment Area, which <br />described the property located within the Sausalito Assessment Area, contained a brief and <br />general description of the Sausalito Shores Subdivision Wall, determined the Project Cost, <br />described the method of apportioning the Project Cost among Platted Lots, established an <br />estimated rate of assessment and method of collection, authorized the date, time, and place of <br />the public hearing to consider the adoption of the Final Assessment Resolution, and directed the <br />preparation of the Assessment Roll and the mailing and publication of notice of such hearing. <br />(H) The Assessment Roll has heretofore been filed at the offices of the City Clerk, City <br />Hall, 95 Triplet Lake Road, Casselberry, Florida, and made available for public inspection. <br />(1) As required by the terms of the Ordinance and the Initial Assessment Resolution, <br />notice of a public hearing has been published and mailed to each affected property owner notifying <br />such property owner of the opportunity to be heard. The proof of publication and an affidavit of <br />mailing are attached hereto as Appendices A and B respectively. <br />(J) A public hearing has been duly held and comments and objections of all interested <br />persons have been heard and considered as required by law. <br />(K) The Assessments contemplated hereunder will be imposed by the City <br />Commission, not the Property Appraiser or Tax Collector. Any activity of the Property Appraiser <br />or Tax Collector under the provisions of this Resolution shall be construed solely as ministerial. <br />(L) The benefits derived from construction of the Sausalito Shores Subdivision Wall <br />for any Tax Parcel subject to the Assessment does not exceed the proportional benefits that such <br />Tax Parcel will receive compared to any other Tax Parcel. <br />(M) The City Commission hereby finds and determines that the Assessments to be <br />imposed in accordance with this Final Assessment Resolution provide an equitable method of <br />funding the design and construction of the Sausalito Shores Subdivision Wall by fairly and <br />reasonably apportioning the benefit conveyed among specially benefited properties. <br />SECTION 4. RATIFICATION AND CONFIRMATION OF INITIAL ASSESSMENT <br />RESOLUTION. <br />(A) The Initial Assessment Resolution is hereby ratified and confirmed. <br />(B) Any and all prior actions of the City Commission associated with the imposition of <br />the Assessments to fund the Sausalito Shores Subdivision Wall, are hereby approved, ratified <br />and confirmed in their entirety. <br />2 <br />
