SECTION 5. APPROVAL OF ASSESSMENT ROLL. The Assessment Roll, which is on <br />file with the City Clerk and incorporated herein by reference, is hereby approved. <br />SECTION 6. CAPITAL IMPROVEMENT ASSESSMENTS. <br />(A) The Tax Parcels described in the Assessment Roll are hereby found to be specially <br />benefited by the design, construction and financing of the Sausalito Shores Subdivision Wall. The <br />apportionment methodology for the Assessments, as set forth in Section 3.04 of the Initial <br />Assessment Resolution, is hereby approved. Accordingly, an Assessment in the amount of <br />$6,059.00 per Benefit Unit is hereby levied and imposed against each Tax Parcel described in <br />the Assessment Roll. <br />(B) Such Assessment shall be collected in annual installments over a period not to <br />exceed twenty (20) years in accordance with section 3.05 if the Initial Assessment Resolution. <br />(C) Each annual installment of the Assessment shall include principal and interest <br />associated with the Obligations and a pro rata share of Collection Costs. At an assumed interest <br />rate of 3.11 % per annum, the maximum annual installment is estimated to be $364.39 per Benefit <br />Unit which includes Collection Costs. <br />(D) The Assessment shall constitute a lien against Assessed Parcels equal in rank and <br />dignity with the liens of all state, county, district or municipal taxes and other non -ad valorem <br />assessments. Except as otherwise provided by law, such lien shall be superior in dignity to all <br />other liens, titles and claims, until paid. The lien shall be deemed perfected upon adoption of this <br />Final Assessment Resolution and shall attach to the property included on the Assessment Roll <br />as of January 1, 2019, the lien date for ad valorem taxes. <br />SECTION 7. COLLECTION OF ASSESSMENTS. The Assessments imposed hereunder <br />shall be collected pursuant to the provisions of the Initial Assessment Resolution and Uniform <br />Assessment Collection Act. Upon adoption hereof and of the Annual Assessment Resolution for <br />subsequent Fiscal Years, the City Manager shall cause the certification and delivery of the <br />Assessment Roll to the Tax Collector by September 15, in the manner prescribed by the Uniform <br />Assessment Collection Act. The Assessment Roll as delivered to the Tax Collector may be <br />accompanied by a Certificate of Non -Ad Valorem Assessment Roll in substantially the form <br />attached hereto as Appendix C. Notwithstanding anything herein to the contrary, Assessments <br />imposed against Governmental Property, if any, shall be direct billed in accordance with Section <br />5.03 of the Ordinance. <br />SECTION 8. EFFECT OF FINAL ASSESSMENT RESOLUTION. The adoption of this <br />Final Assessment Resolution shall be the final adjudication of the issues presented herein and <br />in the Initial Assessment Resolution (including, but not limited to, the method by which the <br />Assessments are computed and apportioned, the Assessment Roll, and the rate of <br />Assessment) unless proper steps are initiated in a court of competent jurisdiction to secure <br />relief within twenty (20) days from the date of the City Commission's adoption of this <br />Resolution. <br />SECTION 9. CONFLICTS. All Resolutions or parts of Resolutions in conflict with any <br />of the provisions of this Final Assessment Resolution are hereby repealed. <br />3 <br />
