RESOLUTION 19-3112 A RESOLUTION OF THE CITY COMMISSION OF CASSELBERRY, FLORIDA, RELATING TO THE CONSTRUCTION OF CERTAIN LOCAL IMPROVEMENTS BENEFITTING SPECIFIC PROPERTIES; AMENDING, RATIFYING, AND CONFIRMING THE INITIAL ASSESSMENT RESOLUTION FOR THE SAUSALITO ASSESSMENT AREA; DETERMINING THAT CERTAIN REAL PROPERTY THEREIN IS SPECIALLY BENEFITED BY THE CONSTRUCTION AND FINANCING OF SAUSALITO SHORES SUBDIVISION WALL; APPROVING THE ASSESSMENT ROLL; PROVIDING THE METHOD OF COLLECTION; AND PROVIDING FOR CONFLICTS, SEVERABILITY AND AN EFFECTIVE DATE. BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF CASSELBERRY, FLORIDA, AS FOLLOWS: SECTION 1. AUTHORITY. This Resolution of the City of Casselberry, Florida (the "City") is adopted pursuant to City Ordinance No. 09-1301 (the "Ordinance"), City Resolution No. 19- 3107 (the "Initial Assessment Resolution"), Sections 166.021, 166.041 and 197.3632, Florida Statutes, and other applicable provisions of law. SECTION 2. DEFINITIONS. This Resolution is the Final Assessment Resolution. Capitalized terms not otherwise defined in this Resolution shall have the meanings defined in the Ordinance and the Initial Assessment Resolution. SECTION 3. FINDINGS. It is hereby ascertained, determined and declared that: (A) The findings provided in Section 1.03 of the Initial Assessment Resolution are hereby ratified, confirmed, and incorporated as if set forth fullyherein. (B) The City Commission of the City of Casselberry (the "City") has enacted Ordinance 09-1301 (the "Ordinance"), which authorizes and provides a process for, the imposition and collection of special assessments, sometimes referred to as non -ad valorem assessments, to fund the costs of capital improvements and municipal services which provide a special benefit to the real property subject to the special assessment. (C) The Ordinance authorizes the imposition of Capital Assessments to fund the design and construction of the Sausalito Shores Subdivision Wall, a Local Improvement as defined by the Ordinance, to benefit the property within the Sausalito Assessment Area. (D) The imposition of the Assessment for the Sausalito Shores Subdivision Wall is an equitable and efficient method of allocating and apportioning Project Costs among all Platted Lots within the Sausalito Assessment Area.
