CASSELBERRY CITY COMMISSION
Minutes of June 10, 2019 — Regular Meeting
Page 13 of 17
had been upheld in the appeal to the Circuit Court, as well.
Ms. Amparo Perez, the property owner at 243 Tallwood Drive, addressed the City Commission stating that
she was requesting a waiver of the $3,000 lien imposed by the Code Enforcement Special Magistrate. She
stated she felt that all the verifications and documentation she had submitted to the City had not been
reviewed thoroughly, and that it had never been made clear to her that the City was opposed to her cutting
down the tree which was the subject of the violation. She stated that she was retired and living on a fixed
income, had never been in trouble with the law, and it would be difficult for her to pay the $3,000; therefore,
she was requesting that the City Commission waive the lien.
City Attorney Reischmann advised that at the time of imposition of the lien the Special Magistrate had
apprised the homeowner of the ability for her to make monthly payments over time if there was a financial
issue for her, and that the lien imposed was a payment into the tree bank as reimbursement for loss of the
tree rather than an actual penalty.
MOTION: Commissioner Hufford moved to approve the Code Enforcement Special
Magistrate's recommendation to deny a reduction of the lien imposed in Case
No. 18-001124 from $3,000 to $200.06, and to uphold the original lien amount
imposed of $3,000 on property located at 243 Tallwood Drive. Motion was
seconded by Commissioner Busch. Motion carried unanimously by voice vote
4-0.
Mayor Glancy announced that the presenter for Agenda Item 6.A. — Presentation on Consumer Protection
had arrived at the meeting and that agenda item would now be heard.
6. PRESENTATIONS/COMMENDATIONS
A. Presentation: Consumer Protection
Mayor Glancy introduced Ms. Lenora Spence, Outreach Coordinator with the Division of Consumer
Services, Florida Department of Agriculture, who gave a presentation on consumer protection services that
are provided by the Florida Department of Agriculture, Division of Consumer Services, which included the
following components:
Mission Statement
Areas of Regulation
o Motor Vehicle Repair Shops
o Weights & Measurements
o Fair Rides
o Charitable Organizations
o Florida Do Not Call List
■ Telemarketing Fraud
Complaint Clearinghouse
Community Outreach
