CASSELBERRY CITY COMMISSION <br />Minutes of June 10, 2019 — Regular Meeting <br />Page 12 of 17 <br />comments to those presented at the hearing before the Special Magistrate <br />Budget Impact: Revenue has been budgeted in FY 2019 for Code Enforcement lien payments in the <br />General Fund Violations of Local Ordinances/Code Enforcement revenue account #001-0000-354.20-00 <br />that this lien reduction would adjust. <br />Recommendation: The City Manager and the Community Development Director recommended approval <br />of the Special Magistrate's recommendation to reduce the lien from $1,700 to $1,500, and if the reduced <br />lien amount is not paid within sixty (60) days, the lien shall revert back to the original amount. <br />Audience Participation: The following individual came forward to address this item: <br />1. Ms. Dawn McCraney stated she was the manager for Lake Kathryn Holdings at 1205 S. US <br />Highway 17-92 in Casselberry and she was present to advise the City Commission that the <br />proposed reduced lien amount of $1,500 had been paid but had inadvertently been applied to <br />the utility account, and her company would be submitting a new payment to be applied to the <br />lien. She submitted a copy of the account ledger to the City Clerk for the record showing the <br />payment which had been made. <br />No one else calve forward. <br />MOTION: Vice Mayor Aramendia moved to reduce the Code Compliance Lien in Case <br />No. 18-000251 from $1,700 to $1,500, as recommended by the City's Code <br />Enforcement Special Magistrate, and if the reduced lien amount is not paid <br />within sixty (60) days, the lien shall revert back to the original amount. <br />Motion was seconded by Commissioner Busch. Motion carried unanimously <br />by voice vote 4-0. <br />B. Lien Reduction Request for Property Located at 243 Tallwood Drive <br />Staff Presentation: Community Development Director Chris Bowley stated that the property owner at <br />243 Tallwood Drive was requesting a reduction of the Code Compliance lien entered in Case No. 18-001124 <br />in the amount of $3,000 be reduced to the amount of administrative costs already paid by the property <br />owner in the amount of $200.06. The original violation was for tree removal without a permit. The case <br />was originally presented to the Code Enforcement Special Magistrate on June 14, 2018 and at a subsequent <br />hearing on January 10, 2019 a fine of $3,000 to be paid into the City's Tree Bank was imposed. The <br />property owner has paid administrative costs of $200.06; however, staff does not support a lien reduction <br />in this case as the property owner has not made attempts to replace the removed tree, has not pulled a tree <br />removal permit, nor paid towards tree replacement costs. Further, the property owner filed an appeal with <br />the Circuit Court against the Special Magistrate's decision and the Court ruled in favor of the City in the <br />appeal. Staff recommends that the $3,000 lien imposed by the Code Enforcement Special Magistrate be <br />upheld and the reduction request by the applicant be denied. <br />In response to questions from the City Commission, Mr. Bowley confirmed that the Special Magistrate had <br />upheld the imposition of the $3,000 lien at a hearing for a request by the property owner for reduction of <br />the lien on April 11, 2019. City Attorney Reischmann also reiterated that the Special Magistrate's ruling <br />
