CASSELBERRY CITY COMMISSION <br />Minutes of June 10, 2019 — Regular Meeting <br />Page 10 of 17 <br />"AN ORDINANCE OF THE CITY OF CASSELBERRY, FLORIDA, TO AMEND THE CITY OF <br />CASSELBERRY OFFICIAL ZONING MAP AS ESTABLISHED IN CHAPTER II, ARTICLE IV, <br />SECTION 2-4.3, UNIFIED LAND DEVELOPMENT REGULATIONS OF THE CITY OF <br />CASSELBERRY, FLORIDA, AS AMENDED AND SUPPLEMENTED; AMENDING THE <br />ZONING CLASSIFICATION FROM CG (COMMERCIAL GENERAL) TO PMX-MID <br />(PLANNED MIXED-USE: MEDIUM RISE) FOR APPROXIMATELY 2.176 -ACRES <br />GENERALLY LOCATED ON THE SOUTHEAST CORNER OF STATE ROAD 436 AND <br />OXFORD ROAD, AS DESCRIBED IN SECTION I OF THIS ORDINANCE; PROVIDING FOR <br />CONFLICTS, SEVERABILITY, AND AN EFFECTIVE DATE." <br />Staff Presentation: Planner I Christina Hyson stated that Ordinance 19-1514 amends the Official Zoning <br />Map from CG (Commercial General) to PMX-MID (Planned Mixed -Use: Medium Rise) for approximately <br />2.18 acres generally located at the southeast corner of Oxford Road and State Road (SR) 436. Written <br />notice was posted on the subject property and notification was provided to the surrounding property owners <br />within 500 feet on April 18, 2019. The Planning and Zoning Commission, serving as the Local Planning <br />Agency (LPA), voted unanimously at its May 8, 2019 meeting to recommend denial of the amendment to <br />the City Commission. <br />Approval of the request will create a condition in which the parcel will be bisected by two different zoning <br />designations because the proposed boundaries do not follow platted lot lines or tract lines. Additionally, <br />the subject property does not meet the requirements of the PMX-MID zoning district. The request to amend <br />the Official Zoning Map from CG (Commercial General) to PMX-MID (Planned Mixed -Use: Medium <br />Rise) for the subject property: Does not conform to Policies 1.5 and 8.2 of the Future Land Use Element of <br />the City's Comprehensive Plan; does not comply with Section 2-4.3, Section 2-4.4, and Section 2-5.2 of <br />the City's Unified Land Development Regulations; and is not consistent with the orderly development of <br />land use patterns. <br />Budget Impact: There is no impact to the City Budget. <br />Recommendation: The City Manager and the Community Development Director recommended denial of <br />Ordinance 19-1514 on first reading. <br />Audience Participation: No one came forward to address Ordinance 19-1514. <br />MOTION: Commissioner Hufford moved to approve Ordinance 19-1514 on first <br />reading, as presented. Motion was seconded by Commissioner Busch. Motion <br />failed unanimously by voice vote 0-4. <br />D. Ordinance 19-1515 — City of Casselberry Restricted Hunting Areas <br />The City Clerk read Ordinance 19-1515 by title, as follows: <br />"AN ORDINANCE OF THE CITY OF CASSELBERRY, FLORIDA, AMENDING CHAPTER 18 <br />"ANIMALS", TO ADD A NEW SECTION 18-4, "RESTRICTED HUNTING AREAS", OF THE <br />CITY OF CASSELBERRY CODE OF ORDINANCES TO DESIGNATE CERTAIN AREAS <br />WITHIN THE JURISDICTIONAL LIMITS OF THE CITY AS A RESTRICTED HUNTING <br />
