REDUCTION REQUEST <br />The Special Magistrate advised of the time limits to speak to cases as the respondent was late to the hearing. The <br />property owner will have up to ten minutes to speak. <br />CE -18-001124 243 Tallwood Dr <br />• Cutting trees and shrubs, City Code Section 58-34 <br />• Permit required/tree removal, ULDR Section 3-14.3 <br />• Tree replacement requirements, ULDR Section 3-14.8A <br />Mark Campbell, Code Compliance Supervisor The violation is for not paying the $3,000.00 into the City tree <br />bank, as of April 11, 2019 the property has not come into compliance, administrative cost of $200.06 has been <br />paid. The City of Casselberry does not support a reduction of the fine. <br />The Special Magistrate asked if the fine was the $3,000.00 and not a daily fine, which is typical. <br />Mr. Campbell stated that was correct. Photos were then described. One 42 -inch tree was removed; the <br />replacement would have been seven trees, which the property does not have room for. <br />Amparo Perez, 243 Tallwood Dr, gave testimony and stated the reason she has not complied is that she was <br />asking questions of the City Manager as to what steps she should take to avoid the fine. Ms. Perez stated she <br />does not have the means to pay such a fine. <br />Ms. Perez stated she was misinformed by the City by being told to buy native plants and telling her, she would <br />be responsible for taking care of the area where the tree was removed. What Mr. Perez was told led her to <br />believe she had permission to remove the tree. <br />The Special Magistrate stated she was not there to rehear the case; there was a full hearing before the prior <br />Special Magistrate. <br />Ms. Perez stated the main reason for requesting the reduction is this is a financial burden to her. <br />The Special Magistrate asked how the tree came down. <br />Ms. Perez stated she hired a company. <br />The Special Magistrate asked how much was paid to cut the tree down. <br />Ms. Perez stated she thinks it was $450.00. <br />The Special Magistrate asked if Ms. Perez could go on a payment plan and pay $450.00 every few months to <br />get the lien paid off. The Special Magistrate offered to put the lien in abeyance to start making payments to the <br />City. It was suggested that Ms. Perez come back after making a significant dent in the amount owed, and then a <br />lien reduction would be considered. <br />The Special Magistrate advised that she could either do a flat denial or put the fine in abeyance and monthly <br />payments would be made. This cause was being left up to Ms. Perez. <br />Ms. Perez asked what steps would be needed to make it to the final option, to go in front of the City <br />Commission. <br />Ms. Perez stated she want to try to go to the Commission. <br />The Special Magistrate stated if Ms. Perez wants to go to the City Commission then she would want a denial <br />from her. <br />4 1 P a g e <br />
