The Special Magistrate asked if there was anyone present to speak for CE -17-000485 and to approach the <br />podium. <br />Ilka Ocasio, 214 Cannon Way, advised that they has been fighting with the insurance (company), they were <br />taking a very long time. With all the stress, Ms. Ocasio had a mild stroke and they have been trying to get back <br />on their feet. Ms. Ocasio stated that reducing the penalty would help a lot. <br />The Special Magistrate asked if anyone has anything else to add, there was nothing else. The Special Magistrate <br />also added that she would not normally entertain such a large fine reduction but understood the property owner <br />was working diligently. <br />Finding of Fact- the Special Magistrate made a finding in CE -17-000485, 214 Cannon Way to adopt the City <br />recommendation to reduce fine/lien down to $202.42 (administrative cost). This matter will now be scheduled for <br />the next available City Commission meeting for final determination. <br />CE -18-000251 1205 17-92 HWY <br />• Fence permit required, ULDR Section 2-7.10 <br />Mark Campbell, Code Compliance Supervisor The property was in violation for 34 days, the City does not <br />recommend a reduction ($1,700.00) of the fine due to the length of time it took to come into compliance. <br />Dawn McReany, Property Manager for Lake Kathryn Holdings, advised that they just took over management on <br />January 1, 2019. Ms. McReany was present to speak on the property owner's behalf, since he just changed <br />management companies. Ms. McReany did understand why a reduction would not be given. <br />The Special Magistrate advice she would modify the reduction request a little bit because the property did come <br />into compliance and Ms. McReany took the time to attend the hearing. <br />Finding of Fact- The Special Magistrate made a finding in CE -18-000251, 1205 S 17/92 HWY to reduce the lien <br />about of $1,700.00 to $1,500.00. This matter will now be scheduled for the next available City Commission <br />meeting for final determination. <br />SUBSEQUENT CASES -NON-COMPLIANT FINE IMPOSED <br />18-001329 229 Maltese Cir <br />Mark Campbell, Code Compliance Supervisor advised that the new Property Manager was present to speak to <br />this case. This was a case of extensive roof damage across the entire complex. There has already been an extension <br />of time in the process. <br />The Special Magistrate asked how much of an extension of time was already given. <br />Mr. Campbell stated it was extended to March 11, 2019. <br />Justin Sobleman, Property Manager stated the owner had sent a letter from the roofing company, stating that all <br />of the roofs were structurally sound and there were no active leaks. They are in the process of fighting with the <br />insurance company. <br />Mr. Sobleman stated that Mr. Campbell advised there were some areas with wood rot but he was not able to find <br />where that was. <br />21 Page <br />
