Planning & Zoning Commission/ <br />Local Planning Agency Minutes <br />March 13, 2019 <br />Page 6 <br />to the uses, glass type and three (3) parcels were eliminated from the overlay district. In response to the <br />Commission's question regarding height restrictions, Ms. Hanna stated that the zoning dictates the building height. <br />Mr. Dean Fathelbab, Planner II, reviewed the definitions for bars and lounges and limited <br />commercial/neighborhood commercial activities. <br />Mr. Henson asked if there was anyone in the audience who wished to speak in favor of, or in opposition to, <br />the request. <br />Mr. Tom Sullivan, Gray Robinson Law Firm, 301 East Pine Street, Orlando, Florida came forward. Mr. <br />Sullivan said he was present on behalf of RaceTrac Petroleum regarding the parcels at State Road 436 and Oxford <br />Road - specifically the SunTrust and the old service station parcel. He said these parcels are included in the <br />proposed Oxford Park Overlay District. Mr. Sullivan said in December 2018 a comprehensive plan amendment and <br />rezoning application for the properties was submitted to the City. He said the project consists of four (4) acres with a <br />new RaceTrac service station on half of that land and with other uses on the remainder. He said they were originally <br />told in January that this item would be on tonight's agenda. <br />Mr. Sullivan said the overlay district prohibits service stations. He requested the Planning and Zoning <br />Commission consider modifying the overlay in a couple of respects. Mr. Sullivan distributed a redlined copy of the <br />proposed ordinance requesting a change for service stations/fuel dispensing from a prohibited use to a conditional <br />use for the four (4) asterisk parcels on page 2 of the ordinance (a copy is attached and made a part of the minutes). <br />Mr. Sullivan said they are looking for a fair opportunity to come before the Commission to evaluate their <br />comprehensive plan amendment, rezoning and conditional use request. <br />Mr. Brian Terry, Insite Studio, 8841 Okeechobee Boulevard, West Palm Beach, Florida came forward. Mr. <br />Terry distributed a color concept of the proposed project (a copy is attached and made a part of the minutes). Mr. <br />Terry said the thought and inspiration that goes in to creating a community and place that is unique to Casselberry is <br />phenomenal. He said that color concept that was distributed is a basic plan. Mr. Terry said that RaceTrac is very <br />interested in being a part of Casselberry at State Road 436/Oxford Road. He said RaceTrac controls the entire four <br />(4) acres and they have opportunities that come with the development plan for the remainder of the property. He <br />
