He said staffs <br />recommendation is based on the findings of fact and conclusions of the staff report dated March 13, 2019, and the <br />following conditions: <br />1. The conditional use shall be limited to the location of 1064-1074 State Road 436, and shall apply only <br />to the areas designated in Attachment D attached to the staff report. <br />2. Expansion of this use into additional tenant spaces will require additional conditional use approval. <br />3. There shall be no outside display or storage of goods, materials, or services. <br />4. The conditional use shall commence, and a Business Tax Receipt must be obtained, within 12 months <br />of approval. <br />5. All applicable licenses and permits shall be obtained prior to the commencement of any business <br />activities at the site. <br />6. All signage requires a separate permit and must comply with the ULDR. <br />7. The use shall remain in complete compliance with all City, County and State requirements. <br />8. A new conditional use application shall be required if the use should cease for more than 90 days. <br />9. All of the above conditions shall be fully and faithfully executed or the conditional use shall become null <br />and void. <br />In response to the Commission's question regarding traffic circulation on the site, Mr. Tardif explained that <br />the conditional use review does not require any parking lot modifications. He said parking would be reviewed during <br />the site plan review process. A brief discussion ensued regarding the fire lane located in front of the building, <br />employee parking and the drop off/pick up area. The Commission expressed a concern with the increase in noise <br />levels for the adjacent residential properties. <br />Mr. Dean Fathelbab, Planner II, explained the proposed playground does not trip the threshold for review by <br />the Planning and Zoning Commission. He said that the Development Review Committee would review and approve <br />the proposed project. <br />Mr. Fathelbab said that the noise issue has not come up in the review process at this time. He said there <br />are substantial buffers between the proposed playground area and the nearest residential unit. He said the site is <br />predominantly surrounded by commercial activities. <br />In response to the Commission's suggestion to use the rear of the property for drop off/pick up of the <br />children, Mr. Fathelbab explained that staff has concerns using the rear of the property for ingress/egress. He said <br />due to the design of that area, the fire truck traffic, trash collection and deliveries for the businesses staff wants to <br />reduce the pedestrian traffic at the rear of the building. <br />
