All applicable licenses and permits shall be obtained prior to the commencement of any business <br />activities at the site. <br />6. All of the above conditions shall be fully and faithfully executed or the conditional use shall become <br />null and void. <br />Mr. Henson asked the applicant to come forward. Ms. Becky Wilson, 215 N. Eola Drive, Orlando, Florida <br />came forward. Ms. Wilson said she was representing the proposed developer, Jefferson Apartment Group. She said <br />they are in agreement with staffs recommendation for approval. Ms. Wilson clarified that the 487' measurement is <br />the very top of the roofline. She said each of the buildings is at a height of 35' to the eave. Ms. Wilson said not all <br />the buildings go up to 48' in height. She said it depends on the width of the building as to how tall the building is to <br />make the architecture appropriate. <br />Mr. Henson asked if there was anyone in the audience who wished to speak in favor of, or in opposition to, <br />the request. No one came forward. <br />Mr. Henson asked for a motion to address CU 19-04. Mr. Hale made a motion that the Planning and Zoning <br />Commission approve CU 19-04 to allow for a maximum height extension from 35 feet to 48 feet 7 inches for the Azul <br />at Lake Howell apartments based on the findings of fact and conclusions of the staff report dated February 13, 2019, <br />the six (6) conditions of approval outlined in the staff report with the change to condition 1 that was included in <br />Addendum A and Attachments A- D. Mr. Tizzio seconded the motion. The motion passed unanimously by voice <br />vote. <br />Ninth Item of Business: CU 19-05: 970 State Road 436. A conditional use request to allow a fuel -dispensing <br />service station at the property located at 970 State Road 436. <br />Mr. Jonathan Tardif, Planning Technician, reviewed the information provided in his memorandum dated <br />February 13, 2019 to the City of Casselberry Planning and Zoning Commission. Mr. Tardif said staff recommends <br />the Planning and Zoning Commission approve CU 19-05 to allow a service station and fuel dispensing at 970 State <br />Road 436. He said staffs recommendation is based on the findings of fact and conclusions of the staff report dated <br />February 13, 2019, and the following eight (8) conditions of approval: <br />1. The conditional use shall be limited to the location of 970 State Road 436. <br />2. There shall be no outside display or storage of goods, materials, or services. <br />3. The conditional use shall commence within 90 days of approval. <br />
