Planning & Zoning Commission/ <br />Local Planning Agency Minutes <br />February 13, 2019 <br />Page 3 <br />In response to the Commission's question, Mr. Tardif said that the name references a bakery but they serve <br />a full range of food and baked good. <br />Mr. Henson asked the applicant to come forward. Mr. German Gerena, 863 State Road 436, Casselberry, <br />Florida came forward. There were no questions for the applicant. <br />Mr. Henson asked if there was anyone in the audience who wished to speak in favor of, or in opposition to, <br />the request. No one came forward. <br />Mr. Henson asked for a motion to address CU 19-03. Mr. Hale made a motion that the Planning and Zoning <br />Commission approve CU 19-03 to allow the sale of beer and wine (2COP) for on-site consumption at 863 State Road <br />436 based on the findings of fact and conclusions of the staff report dated February 13, 2019, and the eleven (11) <br />conditions of approval outlined in the staff report including Attachments A — D. Mr. Tizzio seconded the motion. The <br />motion passed unanimously by voice vote. <br />Eighth Item of Business: CU 19.04: Azul at Lake Howell. A conditional use request to allow an increase to the <br />maximum height from 35 feet to 48 feet 7 inches at the Azul at Lake Howell apartment complex located on <br />multiple parcels along Red Bug Lake Road. <br />Mr. Jonathan Tardif, Planning Technician, reviewed the information provided in his memorandum dated <br />February 13, 2019 to the City of Casselberry Planning and Zoning Commission. Mr. Tardif reviewed Addendum A <br />that was distributed to the Planning and Zoning Commission (a copy is attached and made a part of the minutes). He <br />said condition 1 of the conditions of approval was modified. <br />Mr. Tardif said staff recommends the Planning and Zoning Commission approve CU 19-04 to allow for a <br />maximum height extension from 35 feet to 48 feet 7 inches for the Azul at Lake Howell apartments. He said staffs <br />recommendation is based on the findings of fact and conclusions of the staff report dated February 13, 2019, and the <br />following six (6) conditions of approval: <br />The conditional use shall be limited to the sixteen (16) apartment buildings located within the Azul <br />at Lake Howell multi -family development as approved under SPR18-25. <br />The business shall remain in complete compliance with all City, County and State requirements. <br />The conditional use shall be valid for the same duration as the site plan approval of SPR 18-25. <br />Any hazardous waste produced through the construction and development of the apartment <br />complex shall be disposed of according to federal and state laws. No hazardous waste shall be <br />produced on site by future tenants. <br />
