Mr. Henson was elected as Chairman and Mr. Bakalla was <br />elected as Vice -Chairman by a unanimous vote. <br />Fifth Item of Business: Approval of Minutes for the meeting held on December 12 2018 and January 9, 2019 <br />Mr. Henson stated the Chair was open for a motion on the approval of minutes for the meeting held on <br />Wednesday, December 12, 2018 and January 9, 2019. Mr. Hale moved to accept the December 12, 2018 and <br />January 9, 2019 minutes as presented. Mr. Tizzio seconded the motion. The motion passed unanimously by voice <br />vote. <br />Sixth Item of Business: Disclosure of Ex Parte Communications. <br />No disclosure of Ex Parte Communications was made by the Commissioners. <br />Seventh Item of Business: CU 19.03: 863 State Road 436. A conditional use request to allow the sale of beer <br />and wine (2COP) for onsite consumption at the La Terraza Bakery. <br />Mr. Jonathan Tardif, Planning Technician, reviewed the information provided in his memorandum dated <br />February 13, 2019 to the City of Casselberry Planning and Zoning Commission. Mr. Tardif said staff recommends <br />the Planning and Zoning Commission approve CU 19-03 to allow the sale of beer and wine (2COP) for on-site <br />consumption at 863 State Road 436. He said staffs recommendation is based on the findings of fact and <br />conclusions of the staff report dated February 13, 2019, and the following eleven (11) conditions of approval: <br />1. The conditional use shall be limited to the location of 863 State Road 436 as indicated in Attachment C <br />included in the staff report. The conditional use does not apply to the other tenant spaces or buildings <br />on the property. <br />2. All sales and consumption of alcoholic beverages shall be on-site and within dining areas. <br />3. Package sales of alcoholic beverages for off-site consumption shall be prohibited. <br />4. At least 51 percent of gross revenue shall be derived from the sale of food and nonalcoholic beverages. <br />5. The hours of on-site alcohol consumption and sales shall comply with the hours set forth in Section 10- <br />2 of the City of Casselberry's Code of Ordinances and shall only be during times when the primary use <br />(the restaurant) is serving food. <br />6. The business shall remain in complete compliance with all City, County and State requirements. <br />7. There shall be no outside display or storage of goods, materials, services, or vehicles. <br />8. The conditional use shall commence within 120 days of approval. <br />9. All applicable licenses and permits shall be obtained prior to the commencement of any business <br />activities at the site. <br />10. A new conditional use application shall be required if the use should cease for more than 90 days. <br />11. All of the above conditions shall be fully and faithfully executed or the conditional use shall become null <br />and void. <br />
