They entered into a contract with his son to help them
probate the estate, clean-up the house and get it sold. Nobody was aware that the property was in violation, Mr.
Evans had just found out about it in the last day or two, the property is also in foreclosure. It was the bank who
put the tarp on the roof.
Mr. Evans asked for some time to bring the property into compliance. If removing the tarp would bring the
property into compliance that could be done the next day.
The Special Magistrate read over the documents presented.
Mark Campbell, Code Compliance Supervisor stated there is a tarp on the roof and the appearance of the tarp
shows the roof is in need of repair.
The Special Magistrate found the property in violation at the January 10, 2019 hearing, the tarp had been on the
roof since September 2019, and the purpose of the February 14, 2019 hearing was not to revisit the violation. The
question the Special Magistrate had was whether to impose the fine.
Discussion.
Finding of fact: The Special Magistrate made a finding in the following cases
240 Ivy Farm Ln; Casselberry
1021 Wingo Dr; Casselberry
1551 Carlisle Dr; Casselberry
1201 Rolling Ln; Casselberry
850 SR 436; Casselberry
972 Osceola Trl; Casselberry
2324 Coawood Ct #200; Maitland
650 Jasmine Rd; Casselberry
The above came before the Special Magistrate on alleged violations on January 10, 2019, based on testimony and
evidence the properties were found in violation and ordered to comply by 1 pm February 9, 2019 or a fine would
be imposed.
31 Page
