Second Reading of Ordinance 19-1503 — Amending the Future Land Use <br />Designation for the Property Located on Lake Howell Road (LPA 18-14) <br />The City Clerk read Ordinance 19-1503 by title, as follows: <br />"AN ORDINANCE OF THE CITY OF CASSELBERRY, FLORIDA, TO AMEND THE CITY OF <br />CASSELBERRY COMPREHENSIVE PLAN BY PROVIDING FOR A CHANGE OF THE <br />FUTURE LAND USE DESIGNATION FROM SEMINOLE COUNTY COMMERCIAL TO CITY <br />OF CASSELBERRY COMMERCIAL FOR THE NEWLY ANNEXED APPROXIMATELY 0.43 <br />ACRE PARCEL LOCATED ON LAKE HOWELL ROAD, AS DESCRIBED IN SECTION I OF <br />THIS ORDINANCE; PROVIDING FOR CONFLICTS, SEVERABILITY, AND AN EFFECTIVE <br />DATE." <br />Notice of Public Hearing: The Notice of Public Hearing relative to second reading of Ordinance 19-1503 <br />was advertised in the Orlando Sentinel on Thursday, January 31, 2019. <br />Staff Presentation: Planner I Christina Hyson stated that Ordinance 19-1503 amends the Future Land Use <br />Map designation form Seminole County Commercial to City of Casselberry Commercial for the recently <br />annexed property located on Lake Howell Road, with parcel identification number 28-21-30-300-0400- <br />0000, consisting of approximately 0.43 acre. Notification was provided to the surrounding property owners <br />within 500 feet and written notice was posted on the subject property on November 21, 2018. The Planning <br />and Zoning Commission, serving as the Local Planning Agency (LPA) voted unanimously at its meeting <br />on December 12, 2018 to recommend approval of this amendment to the City Commission. The request to <br />amend the Future Land Use Map from County Commercial to City Commercial for the subject property is <br />consistent with the City's Comprehensive Plan; compatible and consistent with the adjacent land uses and <br />zoning districts; and City water service is currently available to the subject property. The site is not within <br />100 feet of City public sewer. Per Section 86-30(c) of the Code of Ordinance, the property is not required <br />to connect to City public sewer. However, future sanitary sewer provision, whether public or private sewer <br />service, will be addressed at the time of site plan review. <br />Budget Impact: There is no impact to the City Budget. <br />Recommendation: The City Manager and the Community Development Director recommended adoption <br />of Ordinance 19-1503 on second and final reading. <br />Public Hearing: Mayor Glancy stated this was a public hearing to hear and consider comments and <br />questions regarding Ordinance 19-1503. Mayor Glancy opened the floor for public participation. The <br />following individual came forward: <br />1. Mr. Allen Arthur stated he was the architect for the development being proposed for the site <br />and he and the property owner, Mr. Adam Gambuzza were present to answer any questions <br />about this item or the next which was the rezoning item for the same property, and that they <br />were hoping for approval by the City Commission. <br />No one else came forward to address Ordinance 19-1503. Mayor Glancy closed the public hearing relative <br />to Ordinance 19-1503. <br />
