Mr. Fathelbab said the Commission could add a condition of approval to the <br />motion to require no parking signs be added to the site. <br />Mr. Henson asked if there was anyone in the audience who wished to speak in favor of, or in opposition to, <br />the request. No one came forward. <br />Mr. Henson asked for a motion to address SPR 18-15. Mr. Van Meter made a motion that the Planning and <br />Zoning Commission approve the major site plan application for the Concord Drive Townhomes (SPR 18-15) based <br />on the site plan with a revision date of November 15, 2018, the findings of fact and conclusions of the staff report <br />dated January 9, 2019, and subject to the waiver and the seven (7) conditions of approval outlined in the staff report <br />including Attachments A — J and adding condition number 8 to state: The addition of guest parking only signs for the <br />guest parking area and adding no parking signs in the appropriate areas. Ms. Campbell seconded the motion. The <br />motion passed unanimously by voice vote. <br />Ninth Item of Business: BA 19.01: 1006 State Road 436. A variance request to Section 2-5.4 to reduce the <br />side corner lot setback from 25 feet to 21.68 feet. <br />Mr. Dean Fathelbab, Planner II, reviewed the information provided in his memorandum dated January 9, <br />2019, to the City of Casselberry Planning and Zoning Commission. Mr. Fathelbab reviewed the variance criteria <br />required to grant a variance. Mr. Fathelbab said the variance application meets all eleven (11) criteria for granting <br />the variance; therefore, staff supports the variance request as presented. He said if the Planning and Zoning <br />Commission chooses to grant the side corner lot line setback variance, BA 19-01, for the property located at 1006 <br />State Road 436, the motion should be based upon the Planning and Zoning Commission's findings of fact and <br />conclusions, the staff report dated January 9, 2019, and the four (4) conditions of approval outlined in the staff report. <br />The conditions of approval are: <br />1. The variance shall only pertain to the proposed patio as displayed in Attachment A. <br />2. A building permit for the construction of the proposed patio shall be obtained within one (1) year of <br />variance approval. This timeline mirrors the approval timeline of the major site plan proposal SPR 18- <br />32. <br />3. The patio shall be designed to blend aesthetically with the main structure. <br />4. All of the above conditions shall be fully and faithfully executed or the variance shall become null and <br />void. <br />
