The use shall remain in complete compliance with all City, County, and State requirements. <br />7. All of the above conditions shall be fully and faithfully executed or the conditional use approval shall <br />become null and void. <br />In response to the Commission's question, Mr. Fathelbab said that this would be a rental community. <br />Mr. Henson asked the applicant to come forward. Mr. Mark Awad, Concord Development Partners, 2159 <br />Montova Point, Winter Park, Florida, Mr. Stephen Ratcliff, 750 Chapman Road, Oviedo, Florida and Ms. Catherine <br />Felter, 630 North Wymore Road, Maitland, Florida came forward. There were no questions for the applicants. <br />Mr. Henson asked if there was anyone in the audience who wished to speak in favor of, or in opposition to, <br />the request. No one came forward. <br />Mr. Henson asked for a motion to address CU 19-01. Mr. Van Meter made a motion that the Planning and <br />Zoning Commission approve CU 19-01, conditional use to allow a twenty (20) unit townhome development, at the <br />proposed Concord Drive Townhome Community at the property located along Concord Drive with Parcel ID # 08-21- <br />30-5BL-HF00-027A based on the findings of fact and conclusions of the staff report dated January 9, 2019, the site <br />plan dated November 15, 2018, and seven (7) conditions of approval outlined in the staff report including <br />Attachments A — C. Ms. Campbell seconded the motion. The motion passed unanimously by voice vote. <br />Site Plan <br />Mr. Fathelbab said staff requests the Planning and Zoning Commission approve the major site plan <br />application for the Concord Drive Townhomes (SPR 18-15). He said the recommendation is based on the site plan <br />with a revision date of November 15, 2018, the findings of fact and conclusions of the staff report dated January 9, <br />2019, and subject to the one (1) waiver request and the seven (7) conditions of approval outlined in the staff report. <br />The following is the waiver request and the conditions of approval: <br />Waiver Requested: <br />1. Waiver from Section 3-15.6: Design and Specifications for Parking and Loading Areas: To allow the <br />proposed guest parking spaces measure 9'x18' and the allow remaining ADA guest parking space <br />measure 12'x18' provided that a 5' access aisle is included beside the ADA space to allow for ample <br />room and access to the vehicle . Staff supports this request due to site constraints and because the <br />applicant is providing the 5' access aisle. <br />
