Ms. Campbell seconded the motion. The motion <br />passed unanimously by voice vote. <br />Mr. Henson asked for a motion to address ZB 19-02. Mr. Lutz made a motion that the Planning and Zoning <br />Commission provide a favorable recommendation to the City Commission for ZB 19-02 to amend the Official Zoning <br />Map from Seminole County A-1 (Agriculture) to City of Casselberry RMF -13 (Medium Density Multi -family) for the <br />subject property located at 547 Lake Howell Road based on the findings of fact and conclusions of the staff report <br />dated January 9, 2019, and the three (3) findings regarding the proposed change to the Official Zoning Map outlined <br />in the staff report including Attachment B. Ms. Campbell seconded the motion. The motion passed unanimously by <br />voice vote. <br />The next two items were discussed together. <br />Seventh Item of Business: CU 19.01: Parcel ID: 08-21-30-5BL-HF00-027A. A conditional use request to <br />construct multi -family residential (20 townhome units) at the subject property located on Concord Drive. <br />Eighth Item of Business: SPR 18-15: Parcel ID: 08.21.30-5BL-HF00-027A. A major site plan request to <br />develop twenty (20) townhomes and associated amenities on the subject property located on Concord Drive. <br />Mr. Dean Fathelbab, Planner II, reviewed the information provided in his memorandums dated January 9, <br />2019, to the City of Casselberry Planning and Zoning Commission. Mr. Fathelbab said staff recommends the <br />Planning and Zoning Commission approve CU 19-01, conditional use to allow a twenty (20) unit townhome <br />development, at the proposed Concord Drive Townhome Community at the property located along Concord Drive <br />with Parcel ID # 08-21-30-5BL-HF00-027A. He said staffs approval is based on the findings of fact and conclusions <br />of the staff report dated January 9, 2019, the site plan dated November 15, 2018, and the seven (7) conditions of <br />approval outlined in the staff report. The conditions of approval are: <br />1. The Casselberry City Commission must adopt Ordinance 19-1502 to rezone the property from CG to <br />CL. If the City Commission does not adopt Ordinance 19-1502 this conditional use approval shall be <br />null and void. <br />2. The conditional use approval is valid for one (1) year from the time the rezoning ordinance is adopted. <br />This mirrors the approval period of the proposed development's major site plan review (SPR 18-15). <br />3. All applicable licenses, permits, inspections, and approvals shall be obtained prior to the <br />commencement of any activities at the site. <br />4. If the developer or residents produce any hazardous waste, it shall be disposed of according to federal <br />and state laws. <br />5. All signage requires a separate permit and must comply with the ULDR. <br />
