First Reading of Ordinance 19-1505 — Amending Various ULDR Sections Relating <br />to Multi -Family Residential Developments and Scrivener's Errors <br />The City Clerk read Ordinance 19-1505 by title, as follows: <br />"AN ORDINANCE OF THE CITY OF CASSELBERRY, FLORIDA, AMENDING THE CITY <br />CODE OF ORDINANCES, PART III, UNIFIED LAND DEVELOPMENT REGULATIONS <br />TABLE 2-5.4, SIZE AND DIMENSION REGULATIONS, TO REPEAL AND REPLACE TABLE <br />2-5.4 TO CORRECT SCRIVENER'S ERRORS, AND TO REDUCE CERTAIN ZONING <br />CATEGORIES' MINIMUM LIVING AREA AND IMPERVIOUS SURFACE RATIOS; TO <br />AMEND SECTION 3-15.2, PARKING SPACES REQUIRED BY USE, TO DECREASE THE <br />PARKING RATIO FOR MULTI -FAMILY RESIDENTIAL; AMENDING SECTION 3-10.12 TO <br />ADD RMF -13, RMF -20 AND PRD TO THE LIST OF ZONING DISTRICTS ABLE TO REQUEST <br />A CONDITIONAL USE APPROVAL FOR BUILDINGS IN EXCESS OF 35 FEET; PROVIDING <br />FOR CODIFICATION, CONFLICTS, SEVERABILITY, AND EFFECTIVE DATE." <br />Notice of Public Hearing: The Notice of Public Hearing relative to second reading of Ordinance 19-1505 <br />was advertised in the Orlando Sentinel on Thursday, January 3, 2019. <br />Staff Presentation: Development Services Manager Emily Hanna stated that Ordinance 19-1505 repeals <br />and replaces Section 2-5.4, Table 2-5.4, Size and dimension criteria; amends Section 3-1.5.2, Parking spaces <br />required by use; and Section 3-10.12, Design criteria for buildings in excess of 35 feet in height, to amend <br />these sections to align with market trends as it relates to multi -family residential developments, and to <br />correct several scrivener's errors found in Table 2-5.4. In response to a question from the City Commission, <br />Ms. Hanna explained that Section 3-10.12 already contained buffer yards and building setbacks which <br />would apply to buildings as they got higher, so staff felt it would be appropriate to add multi -family to it. <br />Budget Impact: There is no impact to the City Budget. <br />Recommendation: The City Manager and the Community Development Director recommended approval <br />of Ordinance 19-1505 on first reading. <br />Public Hearing: Mayor Glancy stated this was a public hearing to hear and consider comments and <br />questions regarding Ordinance 19-1505. Mayor Glancy opened the floor for public participation. No one <br />came forward to address Ordinance 19-1505. Mayor Glancy closed the public hearing relative to Ordinance <br />19-1505. <br />MOTION: Vice Mayor Aramendia moved to approve Ordinance 19-1505 on first <br />reading, as presented. Motion was seconded by Commissioner Busch. <br />Motion carried unanimously by voice vote 5-0. <br />
