Ordinance 19-1504 - Amending the Official Zoning Designation for the Property <br />Located on Lake Howell Road (ZB 18-07) <br />The City Clerk read Ordinance 19-1504 by title, as follows: <br />"AN ORDINANCE OF THE CITY OF CASSELBERRY, FLORIDA, AMENDING THE CITY OF <br />CASSELBERRY OFFICIAL ZONING MAP AS ESTABLISHED IN CHAPTER II, ARTICLE IV, <br />SECTION 2-4.3, UNIFIED LAND DEVELOPMENT REGULATIONS OF THE CITY OF <br />CASSELBERRY, FLORIDA, AS AMENDED AND SUPPLEMENTED; ESTABLISHING THE <br />ZONING CLASSIFICATION OF CITY OF CASSELBERRY OR (OFFICE/RESIDENTIAL) <br />FROM THE SEMINOLE COUNTY ZONING OF RP (RESIDENTIAL/PROFESSIONAL) FOR <br />THE NEWLY ANNEXED + 0.43 ACRE PARCEL LOCATED ON LAKE HOWELL ROAD, AS <br />DESCRIBED IN SECTION I OF THIS ORDINANCE; PROVIDING FOR CONFLICTS, <br />SEVERABILITY, AND AN EFFECTIVE DATE." <br />Staff Presentation: Planner I Christina Hyson stated that Ordinance 19-1504 amends the Official Zoning <br />Map from Seminole County RP (Residential/Professional) to City of Casselberry OR (Office/Residential) <br />for the recently annexed property located on Lake Howell Road, parcel identification #28-21-30-300-0400- <br />0000, consisting of approximately 0.43 acre. Notification was provided to the surrounding property owners <br />within 500 feet and the Planning and Zoning Commission, serving as the Local Planning Agency (LPA), <br />voted unanimously at its December 12, 2018 meeting to recommend approval of the amendment to the City <br />Commission. The request to amend the Official Zoning Map from Seminole County RP <br />(Residential/Professional) to City of Casselberry OR (Office/Residential) for the subject property is <br />consistent with the City of Casselberry Comprehensive Plan and the proposed Commercial Future Land <br />Use designation; compatible and consistent with the adjacent land uses and zoning districts; and City water <br />service is currently available to the subject property. The site is not within 100 feet of City public sewer, <br />so per Section 86-30(e) City Code of Ordinances, the property is not required to connect to City public <br />sewer. However, future sanitary sewer provisions, either public or private sewer service, will be addressed <br />at the time of the site plan review. <br />Budget Impact: There is no impact to the City Budget. <br />Recommendation: The City Manager and the Community Development Director recommended approval <br />of Ordinance 19-1504 on first reading. <br />Audience Participation: The following individual came forward to address Ordinance 19-1504 <br />1. Mr. Allen Arthur stated he was the architect for the development being proposed for the site <br />and he was present at the meeting with the property owner, Mr. Adam Gambuzza. He stated <br />that if the zoning amendment was approved at tonight's meeting he would then begin working <br />on preliminary plans for the project following the City's design standards. <br />MOTION: Commissioner Hufford moved to approve Ordinance 19-1504 on first <br />reading, as presented. Motion was seconded by Commissioner Busch. Motion <br />carried unanimously by voice vote 5-0. <br />
